| المستخلص: | تلعب الثقافة الرقمية دورا كبيرا في تغيير نمط الجريمة، أن يستغل الجاني التطور التقني الرقمي في مجال ارتكاب جريمته، نظراً لما يحتويه المجال الرقمي من ايجابيات كبيرة. أهمها قابلية النظام التقني الرقمي في ارتكاب الجريمة بوقت قياسي فيما لو تم مقارنته بالوقت الذي ترتكب فيه الجريمة التقليدية، كما يمكن للمجرم التقني الرقمي في أن يمحو الآثار الناشئة عن جريمة وبكسبة زر واحدة، فضلا عن ذلك لا تمتلك الجهات التحقيقية الخبرة الكافية التي تمكنهم من التعرف على المجرم الرقمي وكشف هوية، مما يثير ذلك الأمر القلق والشك حول عدم امكانية من السيطرة على الجاني وفرض العقاب الرادع المانع له من تكرار الجريمة مستقبلاً، ما يؤدي ذلك إلى زعزعة ثقة الأفراد بالجهات التحقيقية والقضائية ويخلف موجة من الاضطراب وعدم الاستقرار، وعليه صار لازما البحث عن وسائل وطرق حديثة تضاهي التطور الخطير للتقنيات الرقمية، فعلى الرغم من ايجابيات النظام التقني الرقمي، إلا أن سلبياته أشد أثراً واكبر ضرراً على حقوق الأفراد وحرياتهم إذا ما استغلت تلك الايجابيات في الجانب السلبي المعاكس. The digital culture plays a major role in changing the pattern of crime, as the offender exploits the digital technical development in the field of committing his crime, given the great advantages that the digital field contains, the most important of which is the ability of the digital technical system to commit crime in a record time if compared to the time in which the traditional crime is committed. The digital technical criminal can also erase the effects arising from a crime with a single click. In addition, the investigative authorities do not have sufficient experience to enable them to identify the digital criminal and reveal his identity, which raises concern and doubt about the impossibility of controlling the offender and imposing punishment. The deterrent that prevents him from repeating the crime in the future, which leads to the destabilization of the confidence of individuals in the investigative and judicial authorities and leaves a wave of turmoil and instability, and therefore it became necessary to search for modern means and methods that match the dangerous development of digital technologies, despite the advantages of the digital technical system, but its negatives It will have a greater impact and greater damage on the rights and freedoms of individuals if those positives are exploited in the opposite negative side. |
