| المستخلص: | يعتبر تعدد التشريعات في المادة الاجتماعية من أهم المؤشرات الدالة على اهتمام المشرع الجزائري بتأطير علاقة العمل من خلال وضعه النصوص القانونية سواء تعلق الأمر بعقد العمل وأثاره، أو طب العمل، الوقاية من حوادث العمل والأمراض المهنية، الضمان الاجتماعي وغيرها. غير أنه قد تطرأ ظروف غير متوقعة مع استحالة دفعها -كتفشي فيروس كوفيد 19-حيث لا تلائم النصوص القانونية الموضوعة في ظل الظروف العادية الوضع الحالي، لذلك سعت هذه الدراسة للوقوف على تأثير الظرف الوبائي على علاقة العمل من خلال طرح جملة من التساؤلات حول ضمان المشرع الجزائري الحماية القانونية لها والتي من خلالها تم التوصل إلى القصور التشريعي لضبط عدة مسائل سواء تعلق الأمر بصاحب العمل أو العامل قصد الحفاظ على استمرارية واستقرار علاقة العمل. The multiplicity of legislations in the social matter is only an indication of the Algerian legislator's interest in framing the work relationship by developing legal texts to regulate the various provisions of it, whether it comes to the work contract and its effects, or work medicine, prevention of work accidents and occupational diseases, social security, social insurance, retirement And others. However, unsigned circumstances may arise with the impossibility of pushing them - such as the outbreak of the Corona virus - where the legal texts established under normal circumstances are not appropriate to the current situation, so this study sought to determine the impact of the epidemiological situation on the work relationship by raising a number of questions about the guarantee of the Algerian legislator Legal protection has the intent to preserve its continuity and stability, through which legislative omission and its limitations have been reached to control several issues whether it is related to the employer or worker. |
