| المستخلص: | إن عمل الأطفال بمفهومه السلبي هو العمل الذي يضع أعباء ثقيلة على الطفل ويستغله اقتصاديا مما يؤدي إلى تهديد سلامته وصحته ورفاهيته. فتعتبر ظاهرة عمل الأطفال ظاهرة عالمية بدأت تنتشر وتتوسع في الآونة الأخيرة وتترك آثارا سلبية تنعكس على الطفل بشكل خاص، وعلى الأسرة والمجتمع بشكل عام. فالمجتمعات في جميع أنحاء العالم تعاني من انتشار ظاهرة تشغيل الأطفال التي تسمى بظاهرة عمالة الأطفال، مما دفع بالمجتمع الدولي للتدخل من خلال عدة منظمات وهيئات دولية لتنظيم عمل الأطفال. ونظرا لحرص الجزائر على محاربة ظاهرة عمالة الأطفال والوقاية منها صادقت على اتفاقية منظمة العمل الدولية، وكذا اتفاقية الأمم المتحدة حول حقوق الطفل واتخذت مجموعة من الإجراءات لتجسيد محتوى تلك الاتفاقيات وكرستها في منظومتها القانونية لمنع كل أشكال تشغيل الأطفال ما لم يحظ تشغيلهم بتأطير قانوني يحدد الشروط التي يجب أن يحيط تشغيلهم، حيث أولى المشرع الجزائري فئة الأطفال العمال عناية خاصة، من حيث تحديد سن العمل والتمهين، مرورا بمنع تشغيلهم في ظروف غير لائقة، فضلا عن تقرير عقوبات على مخالفة الأحكام والضوابط الخاصة بعمالة الأطفال. Child labor, in its negative sense, is work that places heavy burdens on the child and exploits him economically, thus threatening his safety, health and well-being. The child labor phenomenon is considered a global phenomenon that has started to spread and expand in recent times and have negative effects that affect the child in particular, and the family and society in general. Societies around the world suffer from the spread of child labor, which is called the child labor phenomenon, which prompted the international community to intervene through several international organizations and bodies to regulate child labor. And in view of Algeria's keenness to combat and prevent child labor, it has ratified the International Labor Organization Convention, as well as the United Nations Convention on the Rights of the Child, and has taken a set of measures to embody the content of those conventions and enshrined it in its legal system to prevent all forms of child labor unless their employment is permitted A legal framework defines the conditions that must surround their operation, as the Algerian legislator gave special attention to the category of child laborers, in terms of determining the age of work and demeaning, through preventing their employment in inappropriate conditions, as well as deciding on penalties for violating the provisions and regulations on child labor. |
