| المستخلص: | الخطأ والنسيان وجهان لعملة واحدة فهما يقعان عن غير قصد تام من الإنسان، ولكن جزائهما مختلف في الدين والدنيا، ففي الدين لا يحاسب المولى عز وجل عباده على ما وقع منهم بالخطأ أو النسيان، أما في الدنيا فكل من أتلف شيئا وعمل أو مال إنسان عن طريق الخطأ عليه الضمان لأنه ضمان مال لا جزاء فعل. أما العقوبة الجنائية وهي المقصودة من تلك الورقة البحثية فجزاء المخطئ في المسؤولية كالعامد تماما ولا فرق بينهما لأن كلاهما ارتكب فعلا نهى عنه الشارع، ولكن سبب المسؤولية يختلف، فمسئولية العامد سببها أنه تعمد عصيان أمر الشارع وقصد إتيان ما نهى عنه الشارع أو ترك ما أوجبه، ومسئولية المخطئ سببها أنه عصيان أمر الشارع من عن قصد ولكن عن تقصير وعدم تثبت. وهناك تكاليف مختلفة للناسي والخاطئ. Fault and forgetfulness are two sides of the same coin, since they are unintentionally occurred by man, but their punishment is different in Islam and law. In Islam, the Almighty does not punish his righteous for what had happened by them by Fault or forgetfulness. In our world, everyone who damaged something, work, or money by Fault or forgetfulness, he must guarantee because it is a guarantee of money. In the criminal sentence (which is the intent of this research), the punishment on people at fault like the one who committed the crime intentionally and there is no difference between them because both of them actually committed what is forbidden in the law. But the reason for the criminal sentence is different as the responsibility of the intent is because he deliberately disobeyed the order of the street and intended to bring what he forbade the street or leave his duty. The responsibility of the one who is committed by fault is that he disobeyed the order of the street from intentionally, but by default and failure to prove. There are different costs for people and faulty. |
