| المستخلص: | يحتل العرف الدستوري مكانة هامة كمصدر رسمي للقانون الدستوري إلى جانب التشريع والدستور المكتوب، ولاسيما في بلاد الدساتير المكتوبة؛ ويعتبر مصدر رئيسي في البلاد ذات الدساتير غير المكتوبة. أن تقسيم الدستور إلى مدون وغير مدون هو تقسيم نسبي، فالدستور المدون لا يمكن أن يستغني عن الأعرف الدستورية، فقد يقتصر دور تلك الأعراف الدستورية على تفسير تلك النصوص الدستورية، ولها القابلية على تكملتها أو تعديلها. ويتكون العرف من عنصرين؛ الأول السلوك المادي الذي يتكرر تطبيقه بانتظام لا انقطاع فيه؛ والثاني هو شعور أطراف العلاقة التي تنظمها القاعدة العرفية بضرورة الالتزام بها والعمل بموجبها؛ وسريانها في المستقبل على موضوع العلاقة. للعرف أنواع مختلقة من حيث القيمة القانونية لكل منها. Constitutional custom occupies an important position as an official source of constitutional law alongside legislation and the written constitution, especially in countries with written constitutions. It is considered a major source in countries with unwritten constitutions. Dividing the constitution into codified and uncodified is a relative division, as a codified constitution cannot dispense with constitutional norms, as the role of those constitutional norms may be limited to the interpretation of those constitutional texts, and they have the ability to supplement or amend them. The custom consists of two components; The first is physical behavior whose application is repeated with uninterrupted regularity; The second is the feeling of the parties to the relationship that is organized by the customary rule of the necessity of adhering to it and acting according to it; And secrets in the future on the subject of the relationship. Customs have different types in terms of the legal value of each. |
