| المستخلص: | ولغرض أن تقوم البعثات الخاصة بأداء مهامها على أكمل وجه فقد منحتها اتفاقية البعثات الخاصة لعام ١٩٦٩ عددا من الحصانات والامتيازات المشابهة إلى حد كبير للتي تم منحها لمبعوثي البعثات الدائمة والتي سنبينها بشكل تفصيلي في ثنايا هذه الرسالة وأيضا رتبت الاتفاقية المسؤولية القانونية الدولية في حالة قيام الدول بانتهاء هذه الحقوق التي نظمتها الاتفاقية لأعضاء البعثات الخاصة وقد جاء في ديباجة الاتفاقية أن مقصد هذه الامتيازات والحصانات المتصـلة بالبعثات الخاصة ليس إفادة الأفراد بل تأمين الأداء الفعال لوظائف البعثات الخاصة باعتبارها بعثات تمثل الدولة، ولغرض تأدية البعثات لدورها بأكمل وجه فقد منحتها الاتفاقية عددا من الامتيازات والحصانات التي تمكنها من تأدية مهامها التي بعثت من أجلها وقد استقرت هذه الحصانات والامتيازات لمبعوثي الدول في البعثات الخاصة في العرف الدولي والتعامل الدولي خصوصا بعد ما تم تدوينها بشكل نصوص قانونية ملزمة في اتفاقية البعثات الخاصة وذكرت الاتفاقية أن استمرار قواعد القانون الدولي العرفي في تنظيم المسائل التي لا تنظمها أحكام هذه الاتفاقية ومنها ما يتعلق بامتيازات وحصانات مبعوثي الدول. وتتمتع البعثات الخاصة بعدد من الحصانات والامتيازات والحقوق التي منحت لها بموجب اتفاقية البعثات الخاصة، لغرض تأدية وظيفتها بحرية تامة وعلى اكمل وجه حيث نصت الاتفاقية على تمتع مقر البعثة الخاصة بعدد من الحصانات والامتيازات المادية والمعنوية وكذلك نصت على تمتع أعضاء البعثات الخاصة بعدد من الحصانات والامتيازات منحت الحصانات والامتيازات للمبعوث الخاص لغرض أن يستطيع إتمام عمله باستقلال تام وحرية بدون أي تدخل من الدولة المستقبلة فيتمتع أعضاء هذه البعثات بالحصانة القضائية وحصانة مقر السكن وحصانة المراسلات البريدية والرسائل الخاصة وكذلك منحتهم الاتفاقية عددا من الامتيازات التي تسهل لهم أداء مهامهم كما رتبت الاتفاقية المسؤولية القانونية الدولية على الدولة المستقبلة للبعثة في حالة انتهاكها لهذه الحصانات والامتيازات التي يتمتع بها أعضاء البعثات الخاصة لديها.
