| المستخلص: | تعد القرون المتأخرة في التاريخ الإسلامي، غزيرة في الإنتاج العلمي إذ أسهم العلماء والفقهاء الذين عاشوا في تلك القرون في تأليف عدد كبير من المصنفات التي تناولت حقولا متعددة في الفكر الإسلامي لتلك الحقبة، ويلاحظ المتتبع أن التأليف عند بعض الفقهاء اتجه نحو الجزيئات والتعمق فيها فاستنبطوا معالجات لها تتواءم مع مستجدات الأمور. ومما ألف في هذا المجال رسالة (الاقحصاري) الموسومة (بيان أحكام الأراضي). ففي هذه الرسالة تناول الشيخ (الاقحصاري) أنواع الأراضي الزراعية من حيث ملكية رقبتها والتبعات المالية الواجبة على مستثمرها، وبين بعض الاستثناءات التي طبقت في استثمارها، وبين حدود ما يحق لمن يملك هذه الأنواع من الأراضي التصرف فيها، من بيع، وهبة، ووقف، وغيرها من أوجه التصرفات الناقلة للملكية. وتطرق إلى مقادير الخراج الذي فرض على هذا النوع من هذه الأراضي. وحدده بنظامين، وأعطى معلومات وافية عن كل منهما. In this message, Sheikh (Al- Aqsaari) dealt with the types of agricultural lands in terms of ownership of its neck and the financial consequences due on its investor, and among some exceptions that were applied in its investment, and between the limits of what the owner of these types of land is entitled to dispose of, such as sale, gift, endowment, and others Among the aspects of the conduct of the transfer of ownership. And he touched upon the amounts of the exclusion imposed on this type of land. And defined it with two systems, and gave adequate information about each of them. |
