| المستخلص: | تعد العلاقة بين الشريعة الإسلامية والقواعد الدستورية محل جدل كبير في الجوانب الفقهية والسياسية والقانونية، وتمثل هذه العلاقة نقطة خلاف بين الكثير من الباحثين والمفكرين، ولعل ذلك يرجع إلى النظرة التي ينطلق منها كل باحث في هذا الموضوع، ولا نبالغ بقولنا إن العلاقة بين الشريعة الإسلامية والدستور تمثل في زماننا الحالي حلقة صراع كبرى بين الدول، وخاصة في مجال حقوق الإنسان، وقد زادت هذه المناقشات والأفكار في الظهور بعد ما عرف بالربيع العربي والبدء في وضع دساتير لبعض الدول التي شهدت تحولات سياسية جذرية، وبدأ الحديث عن مكانة الشريعة الإسلامية في الدساتير المقبلة ومكانها بالنسبة للدستور، وبالتالي للتشريعات للأخرى التي تلي الدستور في المرتبة، ولبست ليبيا ببعيد عن هذه المسألة كوها تمر بمرحلة وضع دستور جديد، تظهر فيه الحاجة لبيان مكانة الشريعة الإسلامية منه ومن التشريعات الأخرى، خاصة أن الدولة الليبية مرت بعدة مراحل دستورية كان لكل مرحلة مها قواعدها القانونية التي تنظمها، وبالتالي كان هذا البحث وسيلة للتعرف على دور الشريعة الإسلامية في صياغة الدساتير وأثرها على التشريعات بمختلف درجاتها. The relationship between Islamic law and constitutional rules is subject of controversy in the jurisprudential, political and legal aspects; this relationship represents a point of contention between many researchers and thinkers. Perhaps this is due to the point that every researcher bases on this topic, and we do not exaggerate when we say that the relationship between Islamic law and the constitution in our current time represents a major conflict between countries, especially in the field of human rights. These discussions and ideas increased in the emergence of what was known as the Arab Spring and the start of drafting constitutions for some countries that underwent radical political changes. A discussion began about the position of Islamic law in future constitutions and its position in relation to the constitution and thus other legislations that follow the constitution in rank. Libya is not far from this issue, as it is going through a stage of drafting a new constitution, in which the need arises to indicate the status of Islamic law from it and from other legislation, especially since the Libyan state went through several constitutional stages, each of which had its legal rules. It was organized by them, and thus this research was a way to learn about the role of Islamic law in drafting constitutions and its impact on legislation of various degrees. |
