| المستخلص: | انتشرت السفرات السياحية في واقعنا المعاصر وتعددت أنواعها نتيجة تطور وسائل النقل والمواصلات فضلا عما نراه من تقدم تقني وتكنولوجي شمل جميع مجالات الحياة؛ ولعل حجز الغرفة أثناء السفرة السياحية يمثل حجر الزاوية لضمان راحة السائح، إلا أن الأمر لا يخلو من ظهور إشكاليات تتعلق بهذا الحجز ونوع الغرفة ومدى توفيرها لرغبات السائح الأمر الذي يستدعي خضوعها لقواعد القانون لإزالة أية مشكلة قد تظهر، ولا يثير الأمر أية صعوبة إذا كانت السفرة داخلية وكان جميع اطراف العلاقة من العراقيين إذ يطبق القانون العراقي عندئذ إلا أن الإشكاليات تظهر اذا كانت السفرة السياحية تتسم بالصفة الدولية لكون احد أطرافها أجنبيا أو تتم في حدود دولة أو مجموعة دول أخرى حينها يثور التساؤل حول القانون الذي سيحكم تلك الإشكاليات وهذا ما حاولنا تحديده خلال صفحات هذا البحث الذي قسمناه إلى مبحثين وضحنا في الأول التعريف بالسفرة السياحية وحجز الغرفة وبينا طبيعتهما القانونية واهم الأثار المترتبة على العقد الذي تمتا بناء عليه أما المبحث الثاني فخصصناه لبيان القانون الواجب التطبيق على المسؤولية المدنية الناجمة عن إشكاليات حجز الغرفة الفندقية في السفرة السياحية. Tourist trips have become very common and their types have become varied in our modern reality due to the development of means of transportation and communications in addition to the technical and technological advancements in all fields of life. Booking a room during a tourist trip may be the cornerstone of insuring a traveler's comfort. However, there are some problems associated with booking a room for a trip, the type of the room, and the service that these rooms may provide to satisfy the traveler's needs. This requires compliance with the rules of laws to avoid any obstacles that may occur. In cases of trips within the same region and when all travelers are of Iraqi nationality, such problems will not arise with the Iraqi law implemented. Obstacles, however, may occur in international trips; with one of its parties is a foreign one or when the trip takes place within the borders of another country or group of countries. Then the question will be about the laws governing such obstacles. The aforementioned subject is what we are trying to explain within our research. This research is divided into two chapters, in the first chapter, we explained the tourist trip and the matter of booking a room in a legal point of view in addition to explaining the most important implications of the contract according to which it was made. As for the second chapter, it explains the applicable laws of the civil liability occurring due to the obstacles of booking a hotel room during a tourist trip. |
