| المستخلص: | مكافحة الجرائم الدولية تعد ضرورة ملحة للمجتمع الدولي نظراً لما له ارتباط وثيق بالمساس بالأمن واستقرار المجتمع والدول، حيث في العديد من المناسبات تمت دعوة المجتمع الدولي وحكومات الدول بالالتزام بمكافحة الإفلات من العقاب، وعلى هذا النحو قد تبني منظومة قانونية دولية تتواءم والتشريعات الوطنية بشكل متكامل ومنسجم، تهدف الى مكافحة تلك الجرائم الدولية، منها حث حكومات الدول على اتخاذ جملة من التدابير الاساسية لمكافحة الجرعة الدولية امتثالا اولا لمسؤوليتها في مجابهة مكافحة الجرعة وفق القانون العام، وإلى ما تعهدت به من خلال القانون الدولي العام، ومن ثمة تأتي تلك التدابير والإجراءات في سياق تجريم الأفعال التي تشكل جرائم دولية لدمج تلك الاحكام المنبثقة عن القانون الدولي ضمن التشريعات الداخلية، إلى جانب ذلك ايضا اتخاذ جملة من الوسائل القانونية والقضائية في ملاحقة مرتكبي تلك الجرائم الدولية والمتمثلة في اجراء تحقيق مستقل وفعال وتقديم المتهمين إلى المحاكمة. بالإضافة إلى اسناد وتوزيع الاختصاص القضائي الوطني والدولي في سياق مبدئ التكامل والتعاون القضائيين. Combating international crimes is an urgent necessity for the international community, given what is closely related to compromising the security and stability of society and countries. On many occasions, the international community and the governments of countries have been called upon to commit to combating impunity, and in this way it may build an international legal system that harmonizes with national legislation in an integrated and harmonious manner. It aims to combat these international crimes Including urging the governments of countries to take a number of basic measures to combat international crime in compliance first with their responsibility to combat crime in accordance with public law, and to what they have undertaken through international law, and from there these measures and procedures come in the context of criminalizing acts that constitute international crimes. To incorporate those provisions emanating from international law into domestic legislation, In addition to that, a number of legal and judicial means are also taken to prosecute the perpetrators of these international crimes, which are to conduct an independent and effective investigation and bring the accused to trial. In addition to assigning and distributing national and international jurisdiction in the context of the principle of judicial integration and cooperation. |
