| المستخلص: | يهدف البحث إلى إبراز أهمية مقاصد المكلفين، وأثره في تغير الفتوى من خلال دراسة تطبيقية على فتاوى اللجنة الدائمة للبحوث العلمية والإفتاء. ويتكون البحث من مقدمة وثمانية مباحث، وخاتمة. المقدمة وتشتمل على موضوع البحث، ومشكلته، وأهميته، وهدفه، ومنهجه، وإجراءاته، وخطته، والدراسات السابقة. منهج البحث: المنهج الاستقرائي الذي يقوم على تتبع ضوابط مقاصد المكلفين المؤثرة على الفتوى، وجمعها تحت منظومة واحدة. والمنهج التطبيقي الذي يقوم على معرفة كيفية ربط الفتوى بمقاصد المكلفين، عن طريق دراسة تطبيقية لتأثيرها على الفتاوى أهم نتائج البحث: ينقسم البحث إلى جانبين: جانب نظري وجانب تطبيقي، الجانب النظري يتضمن عدة مباحث، منها: تقسيمات ومراتب المقاصد، وأثرها على الفتوى، وطرق معرفة مقاصد المكلفين، وجملة من الضوابط المؤثرة في مقاصد المكلفين. والجانب الثاني تضمن دراسة تطبيقية على فتاوى اللجنة الدائمة للبحوث العلمية والإفتاء، وظهر من خلالها أثر مراعاة مقاصد المكلفين في الفتوى. The research aims to highlight the importance of the objective of the Mukallaf (legally responsible), and its important on changing the fatwā through an applied study on the fatwas of the Permanent Committee for Scholarly Researches and Iftā. The research consists of an introduction, eight chapters, and a conclusion. Introduction: It includes the research topic, its problem, its importance, its aims, methodology, procedures, plan, and previous studies. Research methodology: an inductive approach that is based on following the conditions of the purposes of responsible which has an impact on the fatwā, and compiling them under one system. And the applied approach that is based on knowing how to link the fatwa to the purposes of the Mukallaf, through an applied study of its impact on fatwās. The most important findings of the research: The research is divided into two aspects: the theoretical aspect and the practical aspect. The theoretical aspect included several chapters, including: Divisions and levels of the objectives, their impact on the fatwa, the ways for knowing the objectives of the Mukallaf, and a set of conditions affecting the objectives of the Mukallaf. The second aspect included an applied study on the fatwās of the Standing Committee for Academic Research and Issuing Fatwās, and appeared through it the effect of considering the objectives of the Mukallaf in the fatwas. |
