| المستخلص: | إن النص على حماية الحريات السياسية في الدستور، يعتبر ضمانة مهمة للتمتع بهذه الحريات، غير أن النص على هذه الحماية قد يقيد الحرية السياسية مباشرة، أو يذكر مبدأ عام يتعلق بالحريات ثم يحيل تنظيمه للقانون الذي يثقله بقيود صارمة، حيث نجد أن معظم الدساتير العربية نصت على حق الانتخاب، والترشح والاستفتاء، غير أن هذا الأخير لم يكن مكفولا للشعب بل هو وسيلة بيد الرئيس فقط، كما وضعت هذه الدساتير قيودا مباشرة على التمتع بالحريات السياسية وحددت بعضها بعبارات يمكن تفسيرها بعدة تفسيرات، زيادة على إحالة تنظيمها للقانون، وهذا ما يجعل الدول العربية بعيدة جدا عن تطبيق مبادئ الديمقراطية ومخلة بقواعد ممارسة الحريات السياسية.
