| المستخلص: | المرفق العام آلية من آليات تحقيق وظيفة الدولة الوسيلة الأساسية للإدارة لتقديم الخدمات العامة، وعرفت أساليب إدارة المرفق العام تطورا في تقنياته، خاصة الصور الجديدة للعقود الإدارية تماشيا مع التطورات الاقتصادية، وهدف البحث عن مصادر تمويل خارج ميزانية الدولة، والذي انعكس على طبيعة العقود الإدارية في ظل نظام تعاقدي بين القطاعين العام والخاص. من خلال تفويض المرفق العام، وهو انعكاس لفكرة تطور المرفق العام بهدف تحسين نوعية الخدمات وتخفيف الأعباء عن الإدارة وهو ما عمل به المشرع الجزائري الذي ساير هذا التطور من خلال المرسوم الرئاسي رقم 15- 247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، والمرسوم التنفيذي رقم 18- 199 وهي تمثل الإطار القانوني لهذا النوع من العقود الإدارية، محاولة من الدولة في العمل عن البحث عن مصادر جديدة للتمويل العمومي تماشيا مع تطور الحياة الاقتصادية، والاستجابة لوظيفة إنشاء وتسيير المرافق العمومية بواسطة عقود تفويض المرفق العام.
