| المستخلص: | Cette contribution met en évidence le fait que, contrairement à ce que suggère le système pyramidal des normes repris par les édifices constitutionnels, le droit algérien n’a nullement ignoré les règles de droit extra étatiques, spécialement à la faveur des codifications de 1975. Les investigations conduites sur les sources les plus récentes confirment lorsqu’ils n’amplifient pas le constat. Il en est ainsi d’abord, sous l’effet de la mondialisation du droit, du droit applicable aux relations commerciales internationales impliquant des opérateurs algériens. Mais les règles de droit extra étatiques étendent aussi leur domaine dans le jeu des rapports internes, essentiellement au titre de la régulation économique et de la déontologie, encore qu’un constat centré sur le réel puisse laisser sceptique et rejoint l’inévitable interrogation sur le poids du droit dans la société. This contribution highlights the fact that, contrary to what is suggested by the pyramidal system of norms adopted by the constitutional institutions, the Algerian legislator has in no way ignored the rules of extrastate law, especially in favor of the codifications of 1975. The investigations conducted on the most recent sources confirm when they do not amplify the report. It is thus first of all, under the effect of the globalization of law, of the law applicable to international commercial relations involving Algerian operators. But the rules of extratate law are extended in the field of internal relations, mainly in the field of economic regulation and ethics, However, a report centred on the real can make it a subject of skepticism and asks the inevitable question on the weight of the law in society. |
