| 520 | |a يعتبر إجراء ضبط الحاجات في مجال الصفقات العمومية من الأمور الأساسية التي تسبق أي عملية تعاقدية، لذلك نجد النصوص القانونية تلزم مختلف المصالح المتعاقدة بضرورة ضبط وتحديد احتياجاتها بدقة ومهما تكن مبالغ هذه الحاجات قبل الدخول في أي عملية تعاقدية وقبل الشروع في أي إجراء من إجراءات عملية إبرام الصفقة، يجب أن يكون هذا التحديد للحاجات بناء على تقدير إداري صادق وعقلاني، وحسب الشروط التي يوضحها قانون الصفقات العمومية، وبالاستناد إلى مواصفات تقنية مفصلة تعد على أساس مقاييس ونجاعة يتعين بلوغها أو متطلبات وظيفية دون أن تكون هذه المواصفات موجهة نحو منتج أو متعامل اقتصادي محدد. | ||

Le montant de besoins doit être arrêté sur la base d’une estimation administrative sincère et raisonnable, dans les conditions fixées dans le code des marchés publics, par référence à des spécifications techniques détaillées établies sur la base des normes et de performances ou d’exigences fonctionnelles à condition que ces spécifiques techniques ne doivent pas être orientées vers un produit ou un opérateur économique déterminé. | ||
