| المستخلص: | رخصة البناء هي من أهم الرخص الإدارية في مجال الأنشطة العمرانية، بواسطتها تبسط الجهات الإدارية المختصة رقابتها على أنشطة البناء والتعمير، وبدونها لا يمكن إنشاء مدن عصرية حضارية، بل تبقى مجرد أحياء فوضوية تعكر حياة قاطنيها، ونظرا لأهميتها عمل المشرع الجزائري على إعادة تنظيم أحكامها وذلك بسنه للمرسوم التنفيذي 15/19 المؤرخ في 25/01/2015 المحدد لكيفيات تحضير عقود التعمير وتسليمها الذي بموجبه عمل المشرع على النص على آجال معقولة لمنحها وتبسيط إجراءات الحصول عليها واستحداث الشباك الموحد كآلية جديدة تسمح بتسريع وتيرة دراسة الملفات، وحسنا فعل المشرع ذلك، وهذا يجعل الأشخاص يقبلون على طلب الحصول على الرخصة بعد تبسيط إجراءات الحصول عليها وفي آجال معقولة. The construction license is one of most important authorizations of urban activities through which the competent administrative bodies simplify their control over building and urban activities, and without which one can not create modern and civilized towns, but on the contrary they remain anarchic ones that spoil life of their residences. And in view of their importance, the Algerian legislator has strived to reorganize its provisions by issuing the executive decree n°19/15 of January 25 January 2015 fixing modalities of elaboration of urban acts and their delivery thanks to which the legislator has tried to stipulate reasonable periods to deliver them and facilitating their obtention measures with the creation of the unique window as a new mechanism enabling the speed up of the files’ study, and this is in fact what we have talked about in this study. |
