| 520 | |a رافق الاهتمام بتحرير التجارة الدولية اهتمام مواز بقضايا البيئة والصحة، فالمخاطر في هذين المجالين لا تعترف بالحدود السياسية للدول، كما أنها كثيرا ما تشكل قلقا للدول ومصدر توتر للعلاقات التجارية الدولية، ففي غياب تأكيد علمي للعلاقة بين نشاطات التجارة الدولية وهذه المخاطر، تتخذ الدول تدابير احتياطية لتجنب كل احتمال من شأنه الإضرار بصحة الإنسان أو بالبيئة مستقبلا. هذا الوضع، جعل المنظمة العالمية للتجارة- كراع للنظام التجاري الدولي متعدد الأطراف – تولي اهتماما بهذه المسألة في نصوص بعض اتفاقاتها وكذا بواسطة جهازها لتسوية الخلافات، لتتفتح بذلك على مبدأ الحيطة بمقاربة خاصة. | ||
| 520 | |d L’intérêt pour la libéralisation du commerce international à été accompagné par une préoccupation parallèle sur les questions de la santé et de l’environnement, car les risques de cette dernière ne reconnaissent pas les frontières politiques des États, et constituent une source d’une inquiétude aux relations internationales. Dans l’absence d’une certitude scientifique sur la relation entre le commerce international et ces risques, les États doivent prendre les mesures préventives pour éviter toute atteinte potentielles à la santé et à l’environnement. Cette situation pousse l’OMC- le garant de commerce international- à prendre en considération ses préoccupations dans le cadre de l’élaboration de ces accords ainsi qu’avec leur organe de règlement des différends, et mettre en oeuvre le principe de précaution avec une approche spécifique. | ||
| 520 | |f The interest in the liberalization of international trade was accompanied by a parallel interest in environmental and health issues. The risks in these two areas do not recognize the political borders of states, and they often constitute a concern for states and a source of tension for international trade relations. In the absence of scientific confirmation of the relationship between international trade activities and these risks, countries take precautionary measures to avoid any possibility that might harm human health or the environment in the future. This situation has made the World Trade Organization - as a sponsor of the international multi- dimensional trading system - pay attention to this issue in the texts of some of its agreements, as well as through its body for settling disputes, thus opening it to the principle of precaution with a special approach.
