| المستخلص: | تعد فكرة تفويض المرفق العام بالطرق الخاصة خروجا عن الأصل في تسيير وإدارة المرفق العام، يكون الهدف منها عادة ترقية هذا الأخير بالشكل الذي يسمح بضمان استمرارية تأدية خدماته للجمهور بانتظام من خلال تحقيق متطلباته المتنوعة والمتغيرة التي تعجز الدولة عن تحقيقها في ظل الطرق العادية. وعلى الرغم من أهمية هذه الفكرة عموما لارتباطها أساسا بالمصلحة العامة، فإن تفويض المرفق العام بطريق الامتياز يستحوذ القدر الأكبر منها، فعلاوة على كونه يقتصر اعتماده بالوجه الأكبر في المؤسسات العامة الاقتصادية فإنه وفق قانون الاستثمار يعد تأشيرة لاستثمار الأجانب في تلك المؤسسات، الذي قد تفقد معه السلطة المفوضة سلطتها في اتخاذ القرار الانفرادي لتصبح في مركز مساو لمركز الأجنبي كما هو حال امتياز ميناء جن جن. La notion de délégation des services publics par des moyens spéciales est une exception de la règle de la gestion des services publics, a pour objet le développement des services publics et assurer la continuité de la performance des services au public d’une manière régulière à travers la satisfaction des différents besoins au public que l’Etat ne peut l’atteints en appliquant les modes classiques de la gestion des services. En dépit de l’importance de cette notion en général surtout qu’elle est attachée à l’intérêt public, la délégation des services publics par le moyen de la concession est très important dans les entreprises publiques à caractère économique, la concession est le visa pour l’investissement des étrangers dans ce genre des entreprises qui mène à la concession de l’Etat de ses pouvoirs de décision unilatérale et devient en même statut que l’étranger, le cas échéant le port de Djen Djen.
