| 520 | |a "بحث مراعاة مآلات الأحكام وأثرها في الحكم على مبدأ الفصل بين السلطات، يتكون من مطلبين، تطرقنا في المطلب الأول إلى التعريف اللغوي والاصطلاحي للسلطة، ومن ثم انتقلنا إلى تعريف السلطات، والمقصود هي السلطة التشريعية، والسلطة التنفيذية، والسلطة القضائية، ثم عرفنا الفصل بين السلطات، وفي المطلب الثاني تطرقنا إلى المآل لغة واصطلاحا، وعلاقته بمقاصد الشريعة، ثم وضحت العلاقة بين اعتبار المآلات والسياسة الشرعية، وقلنا أن الفصل بين السلطات هو من الأحكام المستجدة الخاضعة في تقديرها إلى المصلحة، التي يجب أن يراعى فيها ظروف الزمان والمكان والحال، آخذين بنظر الاعتبار مآلات الأفعال وما يفضي إليه الحكم عليها من نتائج. وما خلصنا إليه، إن مراعاة الأخذ باعتبار مآلات الأفعال له أثر في الحكم على مبدأ الفصل بين السلطات، من حيث القبول أو الرفض، بما يؤول إليه من مصلحة في منع الاستبداد، وتحقيق مقاصد الشريعة في العدل والحرية. وهو من المبادئ الدستورية الحديثة التي لا تتعارض مع القيم السياسية الإسلامية، ولا مع أحكام الشريعة الإسلامية، فلذا توصلنا إلى وجوب الأخذ به؛ تفاديا من الوقوع بالظلم، والتفرد بالسلطة وإساءة استخدامها، إلا في حالات الطوارئ، كالحروب، والكوارث الطبيعية، وغيرها. فالأصل كما يبدو لي هو الأخذ بمبدأ الفصل بين السلطات، إلا إذا اقتضت الضرورة، حينها يمكن ولمدة محدودة، مشفوعة بأسباب يقرها أهل الشأن، الأخذ بجمع السلطات بيد واحدة." | ||

As we have concluded taking account of the consequences of acts has an effect on the principle of separation of powers in terms of acceptance or rejection with the interest of preventing tyranny and the realization of the purposes of Shari'a in justice and freedom. It is one of the modern constitutional principles that do not conflict with Islamic political values nor with the provisions of Islamic law. Therefore we have reached the need to adopt it in order to avoid injustice individuality and misuse of power except in emergencies such as wars natural disasters and others. The principle seems to me to be the introduction of the principle of separation of powers unless necessary so that for a limited time accompanied by reasons recognized by the people concerned the introduction of the collection of powers." | ||
