| المستخلص: | رقمنة المرافق العمومية ضرورة لم تعد قابلة للجدل، لكن امتدادها إلى بعض الإجراءات الجزائية وتهديدها لمبادئ استقرت مدة من الزمن في وجه التغيرات التشريعية لارتباطها بالحقوق والحريات؛ يثير التساؤل عن مدى مساسها بتلك المبادئ ويضعها موضع التقييم. تقنية المحادثة المرئية عن بعد وما تحمله من مظاهر لرقمنة العديد من الإجراءات الجزائية التقليدية، استحدثها المشرع ووسع مجالها وأحكامها على مراحل، ورغم ما أبداه التطبيق العملي للتقنية من سلبيات؛ المشرع مدعو إلى تداركها تثمينا لإيجابياتها. Digitizing public utilities is a necessity that is no longer debatable. However, its extension to certain criminal proceedings and its threat to principles that have settled for a long time in the face of legislative changes, due to its association with rights and freedoms, raises the question of the extent of its prejudice to those principles and puts it under evaluation. Videoconference and the aspects it carries to digitize many traditional criminal proceedings, have been developed by the legislator who expanded its scope and provisions in stages, Order 20-04 Nevertheless, despite the negative aspects shown by the practical application of technology on some of the judicial rights of individuals, the legislator is called upon to correct it in order to appreciate its advantages. |
