This research is to highlight the aspects of the objective criminal protection of water resources. In ancient times, man relied on earning his livelihood on the simplest things, so he did not resort to chemical or industrial materials, which did not harm the environment, but with technological and industrial progress, man began to enter the environment with new elements alien to it, and with the passage of time these elements began Negatively affect the environment, in addition to attacking the various elements of the environment, such as pollution of water resources. Scientists and specialists in the field of the environment have been interested in the issue of pollution of water resources, and it has gained great importance more than the rest of the other elements of the environment, as the problem of pollution of water resources has become a global and national field for scientific and legal interest, given that water represents one of the environmental areas that require legal protection, and what Exposed to spoiling him and calls for the need to preserve. This research is to highlight the aspects of the objective criminal protection of water resources. كان الإنسان في القدم يعتمد في كسب قوت يومه على أبسط الأمور، فكان لا يلجأ لمواد كيماوية أو صناعية، الأمر الذي لم يؤدى إلى الإضرار بالبيئة، لكن مع التقدم التكنولوجي والصناعي فقد بدأ الإنسان يدخل للبيئة عناصر جديدة غريبة عنها، وهذه العناصر مع مرور الوقت بدأت تؤثر على البيئة سلبا، إضافة إلى الاعتداء على العناصر المختلفة للبيئة، مثل تلوث الموارد المائية. فقد اهتم العلماء والمتخصصون في مجال البيئة بموضوع تلوث الموارد المائية، وحظي بأهمية كبيرة أكثر مما حظيت به باقي عناصر البيئة الأخرى، حيث أصبحت مشكلة تلوث الموارد المائية مجالا عالميا وقوميا للاهتمام العلمي والقانوني على اعتبار أن المياه تمثل إحدى المجالات البيئية التي تستوجب الحماية القانونية، وما تتعرض له من إفساد وتدعو إلى ضرورة الحفاظ عليها. تردي الأوضاع البيئة واختلال التوازن البيئي، وتضرر الأنظمة الإيكولوجية، ويترتب على ذلك التلوث أن الأضرار التي تلحق بعنصر من عناصر البيئة تنعكس آثارها على العناصر الأخرى، فتلوث المحيطات بالزيت يؤدي إلى تلوث الهواء ويؤدي هذا التلوث إلى تلوث الأمطار التي يترتب على سقوطها تلوث التربة والأنهار. من خلال دساتيرها وتشريعاتها إلى وضع قوانين وتوقيع اتفاقيات لحماية البيئة وأيقنت أهمية المحافظة على الموارد المائية وتسييرها باعتبارها موردا أساسيا للتنمية الاقتصادية، وذلك من خلال وضع سياسة وطنية تهدف إلى حماية هذا المورد الحيوي وتوفيره مع ضمان استدامته للأجيال القادمة، وعليه يأتي هذا البحث لإبراز مظاهر الحماية الجنائية الموضوعية للموارد المائية. |
