| 520 | |a لا شك أن الجانب التطبيقي لمقاصد الشريعة الإسلامية، والاهتمام بالوقائع والشواهد الحياتية المختلفة في ضوء المقاصد الشرعية فهما وتنزيلا أمر مهم للغاية، فإنه من المتفق عليه بين علماء المسلمين أن الأحكام الشرعية إنما شرعت لتحقيق مقاصد سامية، سواء كانت على مستوى الأفراد أو الجماعات، فهي شريعة ربانية، عالمية، متوازنة، صالحة للتطبيق في كل زمان ومكان، تناسب ظروف كل عصر وحاجاته، تسعى لتحقيق مصالح العباد ودفع الأذى والضر عنهم، ونظرا لأهمية المقاصد الشرعية على مر العصور، ومعالجة كثير من النوازل ولا سيما في العصر الحديث، أردت إلقاء الضوء على حركة غربية حديثة من حركات هذا العصر في ضوء المقاصد الشرعية، كثرت فيها المؤلفات الغربية، وترجم بعضها إلى العربية، وهي حركة المينيمالزم (Minimalism)، وبيان المبادئ التي قامت عليها، وأن شريعتنا قد كان لها السبق في تأسيس هذه المبادئ، وذلك حتى نتعايش مع معطيات عصرنا بكل صدق وواقعية، فإن الاهتمام بالفقه المقاصدي في العصر الحديث ضرورة ملحة لإظهار محاسن الشريعة الإسلامية وأسرارها، وأنها بمقاصدها صالحة لكل زمان ومكان، إذا ما قورنت بالمبادئ والشعارات الغربية البراقة. | ||

And given the importance of objectives of Shariah throughout the ages and the treatment of many calamities, especially in the modern era, I wanted to shed light on a modern Western movement of the movements of this era in the light of the objectives of Shariah. in which Western Authoresses abounded, some were translated into Arabic, which is the Minimalism movement, and explaining the principles on which it is based, and that our Sharia takes precedence in establishing these principles so that we can coexist with the facts of our time in all honesty and realism. Paying attention to the jurisprudence purposes in the modern era is an urgent necessity to show the advantages and secrets of Islamic Sharia, and that its purposes are valid for every time and place compared to the glamorous Western principles and slogans. | ||
