| المستخلص: | يعتبر التوثيق العقاري المترتب عن عملية المسح أداة عملية هامة لضبط وإثبات الملكية العقارية، إلا أنه قد تثور أثناء عملية التوثيق العقاري عدة منازعات، منها ما هو مرتبط بسير عملية المسح ومنها ما يثار أثناء عملية التحقيق العقاري، أو أثناء عملية ترقيم العقارات بشكل مؤقت أو نهائي، أو تنفيذ ما يترتب بشأنها. إن عدم إتباع هذه الإجراءات أو إهمالها، يخلق عدة نزاعات قد تتسبب فيها الإدارة كما قد يكون المتسبب فيها هو المواطن في حد ذاته. إذ وبالرغم من وجود مجموعة من الأدوات القانونية التي تهدف لحل هذه المشاكل من جهة وحماية حقوق الأشخاص من الاعتداءات التي قد تطولها من جهة ثانية، إلا أن عدم وضوح هذه الأدوات والآليات القانونية من جهة وعدم تطبيقها في حالات أخرى، خلق عدة إشكاليات كشف عنها الواقع وتضاربت بشأنها الآراء، هذه الإشكاليات التي ارتبطت بعملية التوثيق العقاري والتي كان لزاما البحث في كيفية إيجاد حلول لها، لا سيما وأن ذلك من شأنه أن ينعكس مباشرة على مدى ثبوت واستقرار الملكية العقارية مستقبلا. Real estate documentation cadastral, is an important practical tool for controlling and proving real estate. However, during the process of real estate documentation there may be several disputes, including what is related to the process of the survey, or what is raised during the real estate investigation process, or during Real estate numbering process temporarily or permanently, Or the implementation of the consequences thereof. Failure to follow these procedures or neglect them creates many conflicts in which the administration may cause as well as the cause of them may be the citizen himself. In spite of the existence of a set of legal tools aimed at solving these problems in one hand and protecting the rights of people from the attacks that might be its target on the other hand, the lack of clarity of these tools and legal instruments and the fact of its non application, created several issues revealed by reality On which views were disputed, these issues were related to the process of real estate documentation, which had to be searched to find solutions, especially as this would be reflected directly on the stability of property in the future. |
