| المستخلص: | This study dealt with the set of provisions in some netting contracts as legitimate financial actions with many partial legitimate purposes that defect from those provisions and the study concluded a set of results, namely that the partial purposes in netting contracts are multiple; 1- In sales: too many, varied and multiple purposes, including the purpose of mutual consent between contractors. The destination of ownership and the king in the sales contract. There is a purpose of self-esteem and elevation of the Muslim and his value to others. And the point of purity on which it was held. The intention of netting and swap in the sales contract. The intention is to save money between contractors. 2- In renting: the purpose of facilitating people by allowing renting. It is intended to facilitate the performance and pilgrimage of the incapacitated. 3- One of the purposes of sharia in reconciliation is to get souls to the fullest extent, because many of the orders of the Messenger of God - peace be upon him - and his intentions, due to the complement of the souls of his companions, and to carry them on the befitting of the majesty of their rank in religion, are fair in the fullest way, which if he had carried on him all the nation would have been embarrassed against them. The purpose of expediting the delivery of rights to their owners is one of the purposes of sharia law in reconciliation, which is a destination of transcendence. تناولت هذه الدراسة مجموعة الأحكام في بعض عقود المعاوضات، كونها تصرفات مالية مشروعة، تحمل مقاصد شرعية جزئية عديدة، تنشق عن تلك الأحكام وخلصت الدراسة إلى مجموعة نتائج، وهي أن المقاصد الجزئية في عقود المعاوضات متعددة. ففي البيع: مقاصد كثيرة جدا، ومتنوعة، ومتعددة؛ فمنها مقصد التراضي بين المتعاقدين، ومقصد التملك والملك في عقد البيع، وهناك مقصد عزة النفس، والرفع من شأن المسلم وقيمته أمام الآخرين، ومقصد طهارة المعقود عليه، ومقصد المعاوضة والمبادلة في عقد البيع، ومقصد حفظ المال بين المتعاقدين. وفي الإجارة: مقصد التيسير على الناس بإباحة الإجارة، ومقصد تيسير أداء الحج وقضائه عن العاجز. ومن مقاصد الشريعة في الصلح حمل النفوس على الأكمل من الأحوال، فكذلك كثير من أوامر رسول الله- صلى الله عليه وسلم- ونواهيه، الراجعة إلى تكميل نفوس أصحابه، وحملهم على ما يليق بجلال مرتبتهم في الدين، من الاتصاف بأكمل الأحوال، مما لو حمل عليه جميع الأمة لكان حرجا عليهم. ومقصد التعجيل بإيصال الحقوق إلى أصحابها هو من مقاصد الشريعة في الصلح، وهو مقصد من السمو بمكان. |
