| المستخلص: | خلق الله تبارك وتعالى خلقه وهو الغني عنهم لمهمة الخلافة في الأرض، كما أرسل الرسل لهدايتهم للطريق القويم، كما أنه سبحانه قد رتب على الأحكام والأعمال التي يخاطبهم بها مقاصد جليلة وغايات عظيمة، اهتم العلماء بجمعها في علم خاص من علوم الشريعة وهو: علم مقاصد الشريعة، ذلك أن الشريعة الإسلامية الغراء مبناها وأساسها مصالح العباد في أمور المعاش والمعاد، فهي خير كلها، وعدل كلها، ورحمة كلها، ومصالح كلها. وكان من أهم أهداف البحث إلى تحقيق الأهداف التالية: معرفة علاقة التنمية المستدامة بمقاصد الشريعة الإسلامية. وبيان تطبيقات التنمية المستدامة في حفظ مقاصد: الدين، والنفس، والعقل، والنسل، والمال بالتفصيل؛ لإثراء علم مقاصد الشريعة بالأمثلة الواقعية وتسهيل فهمها للناس، ثم العمل وفق مراد الشرع. وتوضيح صلة التنمية المستدامة بحفظ الضروريات، والحاجيات، والتحسينيات. وقد اتبعت في هذا البحث منهجان رئيسان هما: المنهج الاستدلالي الذي ينطلق من النصوص الشرعية التي هي كالقواعد العامة المسلمة بعد التأكد من ثبوتها. والمنهج الاستقرائي في رصد أقوال الفقهاء في المسائل وتحليلها. كما توخيت الاختصار قدر الإمكان، ووثقت النقل عن المصادر بنسبة الأقوال إلى قائليها. وقمت بعزو الآيات إلى سورها، وتخريج الأحاديث من الكتب الستة ونقل حكم العلماء عليها إذا كانت في غير الصحيحين، وتركت الترجمة للأعلام كي لا أثقل البحث بالهوامش. وفي نهاية البحث خلصت إلى النتائج التالية: أن موضوع التنمية المستدامة بالرغم من حداثته إلا أن مبادئه راسية في تاريخ الشريعة الإسلامية منذ الأزل. شمولية الشريعة الإسلامية وصلاحيتها لكل زمان ومكان، ومرونتها في استيعاب المستجدات في كافة المجالات ونواحي الحياة، في كل عصر، أن حفظ الدين على رأس مقاصد الشريعة؛ لأنه أصل ما دعا إليه القرآن والسنة وما نشأ عنهما، أن حفظ النفس من أهم مقاصد الشريعة التي تجلى حفظها في أهداف التنمية المستدامة وتطبيقاتها، العقل هو طريق التمييز بين المصالح والمفاسد، ومعظم مصالح الدنيا ومفاسدها معروف بالعقل، أن حفظ مقصد النسل متداخل مع حفظ مقصد النفس في كثير من جوانبه، ثراء علم مقاصد الشريعة، واستيعابه لكل ما قد يطرأ للمسلمين من حوادث ونوازل في كل مناحي الحياة. وقد أوصيت في نهاية بحثي بـ: الاهتمام والحرص بموضوع التنمية المستدامة، ودراسته من جميع جوانبه الشرعية والصحية والاجتماعية والاقتصادية، تأصيل تطبيقات التنمية المستدامة المتخذة في بلاد المسلمين خاصة وفي العالم عامة، حيث أنها تنطلق من مبادئ الشريعة وأحكامها السمحة. التعمق في دراسة موضوع التنمية المستدامة بالربط بعلوم الشريعة المتنوعة: كالتفسير، والحديث، والفقه، والقواعد الفقهية، وغيرها. عقد مؤتمر علمي يتناول الجوانب المتنوعة لتناول موضوع التنمية المستدامة، وتثقيف الناس بما شرعه الله تعالى مما يؤصل هذه المعاني، من الجانب التربوي والدعوي والفقهي والتاريخي، ونحوه. God created and exalted his creation and is in no need for them in order to populate the earth, as he sent the prophets to guide them to the right way, as he has arranged on the judgments and actions addressed to them by great purposes, the scholars were interested in collecting them in a special science of Islamic law, which is: the science of the purposes of sharia, because the Islamic law(Sharia) is the perfect law and based on the interests of people in matters of daily errands which is full of justice and mercy. One of the most important objectives of the research was to achieve the following objectives: to know the relationship of sustainable development to the purposes of Islamic law, to explain the applications of sustainable development in preserving the purposes of religion, self, mind, offspring and money in detail, to enrich the knowledge of the purposes of Sharia with realistic examples and facilitate their understanding of people, and then to work according to the purposes (murad) of Sharia. To clarify the link between sustainable development and conservation of necessities, needs and improvements. Two main approaches have been adopted in this research: the inference approach, which is based on Islamic texts, which are like the general rules of Islam, after they have been confirmed. The inductive approach, is to monitor and analyze the statements of jurists in matters. It also envisaged the abbreviation as much as possible, and documented the transfer of sources by the ratio of words to the sayings. I attributed the verses to their walls, graduated the hadiths from the six books and quoted the scholars' judgment on them if they were incorrect, and left the translation to the flags so as not to overload the search with margins. At the end of the research, I came to the following conclusions: The subject of sustainable development, despite its modernity, has been at the forefront of Islamic law since time immemorial. The comprehensiveness and validity of Islamic law for every time and place, and its flexibility in absorbing developments in all fields and aspects of life, in every age, that the preservation of religion at the top of the purposes of Sharia, because it is the origin of what the Qur'an and Sunnah called for and what has arisen, that self- preservation is one of the most important purposes of the Sharia, which is reflected in the sustainable development goals and applications, reason is the way of distinguishing between interests and evils, and most of the interests and evils of the world are known by reason, that the purpose of birth preservation is intertwined with the purpose of self-preservation in many aspects, the richness of the knowledge of the world community. Sharia, and its understanding of all incidents that may occur to Muslims in all walks of life. At the end of my research, I recommend: to consider and show care for the subject of sustainable development, and its study in all its legal, health, social and economic aspects, rooting out the applications of sustainable development taken in Muslim countries in particular and in the world in general, as they are based on the principles of sharia and its tolerant provisions. To delve deeper into the subject of sustainable development by linking to the various sciences of Sharia: interpretation, hadith, jurisprudence, and others. Holding a scientific conference to address the various aspects of dealing with the topic of sustainable development, educating people about what Allah has prescribed, which brings these meanings, from pedagogical, doctrinal, historical prospectives and so on. |
