| المستخلص: | يعتبر التحكيم التجاري الدولي وسيلة من وسائل تسوية المنازعات قوامه الخروج عن طرق التقاضي وما تتبعه من إجراءات وما تأخذه من وقت، يهدف إلى حل النزاعات التجارية على المستوى الدولي، منتهيا بحكم نهائي وتنفيذي يحدد حقوق والتزامات الأطراف. ولقد اهتم المشرع الجزائري بالتحكيم التجاري الدولي بموجب القانون رقم 08-09 المتضمن قانون الإجراءات المدنية والإدارية، الذي دأب من خلاله إلى وضع القواعد المحددة لإطاره القانوني والإجراءات اللازمة لتكريس هذا الحكم في أرض الواقع، باللجوء إلى سلطة القاضي الوطني في منح أمر الاعتراف أو التنفيذ لحكم التحكيم التجاري الدولي، والذي يقبل هذا الأخير الطعن فيه بالاستئناف أو بالنقض. International commercial arbitration is considered one of the means of dispute settlement, which is based on deviating from the methods of litigation, the procedures that follow, and the time it takes, aimed at resolving commercial disputes at the international level, ending with a final and executive ruling that defines the rights and obligations of the parties. The Algerian legislator has taken an interest in international commercial arbitration under Law No. 08-09 containing the Civil and Administrative Procedures Law, through which it has consistently set the rules that define its legal framework and the procedures necessary to establish this judgment on the ground by resorting to the authority of the national judge to grant an order for recognition or execution of a judgment International commercial arbitration, which accepts the latter to be challenged by appeal or cassation. |
