| 520 | |a هناك العديد من النظريات التي تسعى إلى إنقاذ القرار الإداري من المصير المحتوم وهو الإلغاء، كما من شأن ذلك الاستجابة لمبدأ هام إلا وهو استقرار الأوضاع الإدارية. حيث يحوز موضوع مفهوم التعديل الجزئي للقرار الاداري وصوره على أهمية بالغه، بقيام الإدارة والقاضي بتعديل القرار الإداري تعديلاً جزئياً وإلغاء ما شابه من انتهاك لمبدأ المشروعية، وبالتالي المحافظة على القرار الإداري دون إعدامه، ومن هنا ظهرت أهمية اللجوء إلى التعديل الجزئي للقرار الإداري من جانب الإدارة مصدره القرار أو الجهة الرئاسية لها دون إلغاء القرار الإداري بأكمله، ومعرفة الحدود التي يقف فيها القضاء الإداري، دون أن يتدخل بشكل غير مشروع في إعمال الإدارة عند إعماله للتعديل الجزئي. | ||

The subject matter of the concept of partial modification of an administrative decision and its form is of great importance, with the administration partially modifying the administrative decision and abolishing similar violations of the principle of legality, thereby preserving the administrative decision without executing it. Hence, the importance of resorting to partial modification of the administrative decision by the administration or its governing body without revoking the entire administrative decision, knowing the limits within which the administrative judiciary is present, without unlawfully interfering with the administration's operation of the partial amendment. | ||
