| 520 | |a يثبت التاريخ أن بني الإنسان على اختلاف أجناسهم قد عاشوا في مجتمعات تختلف في الظروف الجغرافية والتاريخية، وفي المستوى الحضاري، وفي طريقة التنظيم، ولقد نجح نوعنا البشري في البقاء وفي النمو، وفي الوصول إلى مرحلة سامية من المدنية عن طريق تطوير المجتمعات التي تعيش فيها اقتصادياً واجتماعياً وسياسياً، إلى أن اتخذت في الوقت الحالي شكل الدول الحديثة. ومهما كان شكل الدولة أو نظام الحكم فيها فهي لا تستطيع بوصفها جماعة تتمتع بالشخصية القانونية الاتصال بغيرها من الدول وبالمنظمات الدولية إلا عن طريق أفراد يملكون اختصاص تمثيلها والتحدث باسمها. ومن خلال بحثنا قد حاولنا إبراز الأهمية التي اكتسبتها الدبلوماسية في العلاقات ما بين الحضارات العربية والأوروبية قديماً. حيث أجرينا مقارنة بسيطة ما بين تلك الحضارات فيما يتعلق بالدبلوماسية، وشاهدنا ذلك عبر تطورها. وأستقر بنا القول بأن الشعوب القديمة لم تكن تعتبر بالمساواة بينها وبين الشعوب الأخرى، وبالتالي لم تكن فكرة القانون الدولي العام أصلاً واضحة في تلك المجتمعات، لأن الجماعة الدولية بمعناها التقليدي لم تكن نشأت بعد. فهذه الجماعات تفترض وجود مجموعة من الشعوب المستقلة المتساوية في الحقوق وفي الواجبات الأمر الذي يتنافى مع فكرة امتداد سيطرة شعب معين معنوياً أو مادياً على الشعوب الأخرى. وبسبب أهمية الدبلوماسية من قدم التاريخ، نوصي المجتمع الدولي أن يضعها في اهتماماته الأولى، وأن يخصص لها متخصصين في دراسة تاريخها حتى يساهموا في تطويرها الدائم بما يتناسب مع تطور المجتمعات، وأن يضعوا لها الآليات التي تساعد في تفعيلها. فالتحديث لكي يؤتي ثماره يجب دراسة الماضي وتاريخه بإتقان حتى نكون أمام تحديث مؤثر. |f History demonstrates that human beings, regardless of their races, have inhabited societies that vary in geographical and historical contexts, levels of civilization, and organizational methods. Our species has thrived, evolved, and attained a remarkable level of civilization by fostering economic, social, and political development within our societies. This progress has culminated in the establishment of modern states. Regardless of the form of the state or its system of government, it cannot engage in communication with other states and international organizations as a legal entity. This communication is carried out exclusively through individuals who possess the authority to represent and speak on behalf of the state. In our research, we aimed to emphasize the significance that diplomacy acquired in the relations between ancient Arab and European civilizations. We conducted a comparative analysis of these civilizations concerning diplomacy, observing how this aspect evolved over time. We concluded that ancient peoples were not regarded as equals to other peoples. As a result, the concept of public international law was not initially clear in those societies because the traditional international community had not yet emerged. These groups presuppose the presence of independent peoples with equal rights and responsibilities, which contradicts the notion of one people extending moral or material control over others. Due to the paramount importance of diplomacy throughout history, we recommend that the international community prioritize it and allocate specialists to study its history. This will enable them to contribute to its continuous development in alignment with the progress of societies, and establish mechanisms to enhance its effectiveness. To ensure that modernization yields fruitful results, it is imperative to carefully study the past and its history, thereby facilitating effective modernization.
