| المستخلص: | إلى جانب طرق الطعن في الأحكام الإدارية والتي تجد أساسها ومصدرها في التشريع، توجد دعوي البطلان الأصلية ومن خلق القضاء الإداري المصري كما أجاز القضاء الكويتي استثناء رفع هذه الدعوى. ويتناول هذا البحث هذه الدعوى في القضاء الإداري المصري والكويتي، في ثلاثة مباحث، تناول الأول منها بيان ماهية دعوى البطلان الأصلية وأساسها، وتناول الثاني الأحكام الإدارية التي يجوز الطعن فيها بهذه الدعوى وأسباب الطعن، أما المبحث الثالث فكان لبيان المحكمة المختصة بنظر دعوى البطلان الأصلية وإجراءاتها والحكم فيها بنظرها، وذلك في دولتي المقارنة. This research delves into the original claim of invalidity, which has been established by the Egyptian administrative judiciary, in addition to the methods of appealing administrative rulings that are based on legislation. The Kuwaiti judiciary has also allowed an exception to file this lawsuit. The study is structured into three sections regarding this case in the Egyptian and Kuwaiti administrative judiciary: The first section explains the nature of the original invalidation claim and its basis. The second section addresses the administrative rulings that may be appealed in this case and the reasons for the appeal. The third section elaborates on the competent court to consider the original invalidity claim, its procedures, and its ruling in the two compared countries.
