| المستخلص: | يعتبر البيع من أقدم وأكثر العقود الشائعة في الحياة ومن بين صور البيع نجد بيع ملك الغير بتصرفات كانت للرسول الكريم في التعامل وذلك لتبيان جائزية البيع والشراء، ونظرا لانتشارهما وشيوعهما في حياتنا اليومية ومدى تطويرهما للاقتصاد الوطني، الأمر الذي تطلب تنظيمها في قواعد عامة تحكمها في إطار قوانين وضعية شرعها المشرعون والفقهاء تحفظ الإطار العام للتعامل. وسنشير عبر التعاريف القانونية والتقنينات والنصوص الصادرة في القانون الوضعي، ذلك أن القانون هو أساس حماية المالك حماية شاملة، يمنع الغير من الاعتداء على ملكه، كما سنعرج أيضا على التعاريف الفقهية حتى نمزج بين الفقه والقانون، ومن خلال هذه التعاريف نتطرق إلى الطبيعة القانونية لبيع مللك الغير في الشريعة الإسلامية والقانون الوضعي.
