| 520 | |a تناولت الدراسة موضوع أخلاقيات المهن القانونية في عصر النبوة والقوانين والمواثيق الدولية بهدف بيان عظمة وأخلاق وقضاء النبي (صلى الله عليه وسلم)، والتأكيد على أهمية هذه المهن وتحلي شاغليها بالأخلاق الحميدة التي أملتها الشريعة الإسلامية ونصت عليها القوانين الوضعية. وتظهر أهميته في الارتباط الوثيق للمهن القانونية بواقع حياة الناس ومعاملاتهم وبيانها يعود بالنفع على المجتمع. وتتمثل مشكلة الدراسة في النظر إلى الواقع المهن القانونية وسلوكياتها اليوم، والابتعاد عن الأخلاقيات في الممارسة والتطبيق بعيدا عن النهج النبوي الشريف والأنظمة الوضعية من بعض شاغليها، وعدم كفاية النصوص المنظمة لها. أما منهج الدراسة فهو المنهج الاستقرائي بجانب المنهج التاريخي، كما أن الدراسة تأخذ طابع المقارنة. ومن أهم نتائجها: أن أخلاقيات المهن القانونية على نوعين؛ نوع يتناول الأخلاق العامة والتي يجب أن تنطبق على جميع من يمارس تلك المهن، ونوع تختص به كل مهنة على حده، وهي قواعد وسلوك تنظمها قوانين خاصة، ويجوز محاسبة القاضي والمحامي إذا أخل بواجب مهني ولا يجوز أقالتهما إلا إذا ارتكبا جريمة مخلة بالشرف والأمانة ويشترط في إقالة القاضي صدور قرار من رئيس الجمهورية. ومن أهم توصياتها: نشر التوعية والحث على الاقتداء بهدي النبي (صلى الله عليه وسلم) في ممارسة المهن القانونية، ووضع منهج لأخلاقيات المهن القانونية ليدرس ضمن المقررات لطالب القانون وإدخال نصوص على القوانين الخاصة بتنظيم سلوك العمل القضائي ومهنة المحاماة. | ||

Its importance appears in the close connection of legal professions to the reality of people›s lives. And their transactions and their statement is beneficial to society. The problem of the study is looking at the reality of legal professions and their behavior today, and moving away from ethics in practice and application away from the noble Prophetic approach and man-made systems of some of its occupants, and the insufficiency of the texts regulating them. As for the study method, it is the inductive method next to the historical method, and the study takes a comparative nature. Among its most important results: that the ethics of legal professions are of two types; A type that deals with public morals, which must apply to all those who practice these professions, and a type that is specific to each profession separately, and they are rules and behavior regulated by special laws. The judge and the lawyer may be held accountable if they violate a professional duty, and they may not be fired unless they commit a crime against honor and honesty, and the dismissal of the judge requires the issuance of a decision by the President of the Republic . Among its most important recommendations: spreading awareness and urging to follow the guidance of the Prophet (peace be upon him) in practicing the legal professions, and developing a curriculum for the ethics of the legal profession to be studied within the courses of law students and the introduction of texts on special laws regulating the conduct of judicial work and the legal profession. | ||
