| 520 | |a في هذا المقال شيء من التنظير لمصطلح التوجيه الفقهي في المذهب المالكي وبيان لبعض معانيه ومراميه عند ابن بطال في المجالات التي تناولها، مع ذكر بعض الأمثلة والنماذج على ذلك من مؤلفه على شرح صحيح البخاري. فالأقوال والفتاوى لها أصل في الدين يرجع إليه عند التثبت، إلا أنه في كثير من الأحيان لا يصرح المجتهد بمأخذه أو مستنده في ذلك، ولعل هذا هو الباعث عن بعد كثير من المقلدين عن طلب الدليل والاستدلال لكون الفتوي صادر عمن يثق في علمه وورعه. وقد أكسب التوجيه الفقهي الفقه الإسلامي شمولية وخصوبة في التجديد، إذ يتجدد بتجدد الأحداث، ويسمح باستيعاب المستجدات، برد الفروع إلى الدليل الشرعي الإجمالي الشامل لكل الجزئيات، وكذا المقاصد العامة التي جاء التشريع الإسلامي ليحافظ عليها، في شكل قضايا بارزة، أولاها الفقه اهتماماً كبيرا. | ||

The Sayings and Fatwas have an origin in the religion that they refer to when confirming, but in many cases, the Mujtahid does not state his reasoning or reliance on it. Perhaps this is reason behind many imitators to seek evidence and inference since the Fatwa is issued by someone whose knowledge and piety are trusted. The jurisprudential guidance has given Islamic jurisprudence comprehensiveness and fertility in renewal, as it is renewed by the renewal of events, and allows for the absorption of developments, by returning the branches to the comprehensive legal guide that includes all the details, as well as the general purposes that Islamic legislation came to preserve, in the form of prominent cases, and the jurisprudence has given great attention. | ||
