| المستخلص: | جاءت غالبية الدساتير المعاصرة وخاصة الدستور الفلسطيني بالنص والاعتراف بحق المرأة في المشاركة السياسية، وتحقيق المساواة بين المرأة والرجل في الحصول على الفرص والحقوق السياسية، والمشرع الفلسطيني تدخل وشرع قانون انتخابي يجبر الأحزاب السياسية أو القوائم الانتخابية على "كوتا" معينة من النساء في قوائمها الانتخابية، بهدف تعزيز مشاركة المرأة سياسيا عن طريق تخصيص عدد أو نسبة من مقاعد البرلمان للنساء، لأن تمثيلهن على صعيد الواقع لا يتناسب مع حقيقة أنهن يشكلن نصف المجتمع، لذا فإن ضمان الحد الأدنى للتمثيل النيابي للمرأة لا يستهدف بالضرورة المساس بمبدأ المواطنة، بل هو يدعم هذا المبدأ لأنه يسعى إلى تحقيق المساواة النسبية بين المرأة والرجل في مجال التمثيل النيابي. The majority of contemporary constitutions, particularly the Palestinian Constitution, came with the text and recognition of women's right to political participation, equality between women and men in access to political opportunities and rights, and the Palestinian legislator intervened and enacted an electoral law that forces political parties or electoral lists to a certain "quota" of women on their electoral lists, with the aim of promoting women's political participation by allocating a number or percentage of parliamentary seats to women, because their representation in reality is not commensurate with the fact that they make up half of society, so Ensuring a minimum representation of women is not necessarily aimed at undermining the principle of citizenship, but rather supports this principle because it seeks to achieve relative equality between women and men in the area of representation. |
