| 520 | |d La pandémie du COVID-19 est à l’origine d’une véritable crise sanitaire. Les décideurs sont contraints de faire appel aux règles existantes pour gérer la situation mais aussi d’adopter de nouveaux textes afin de trouver des solutions idoines. Les décideurs politiques se trouvent face à des dilemmes qu’ils sont obligés de résoudre, en optant pour des solutions équilibrées. Ils doivent procéder à une pondération des intérêts en jeu et respecter le principe de la proportionnalité entre les différents droits et libertés. Pour leur part, les professionnels de la santé sont tenus de respecter certaines obligations aussi bien lors du diagnostic que lors du traitement. Le médecin doit assumer les conséquences de ses fautes et doit respecter les données acquises de la science, même si en temps du COVID, il est difficile de parler de «données acquises». | ||
| 520 | |a يعد فيروس كورونا جائحة يتعين عل الدول التعامل معها، ومجابهة تداعياتها الصحية والاقتصادية والاجتماعية. وهو ما يطرح إشكالية كيفية تأقلم القواعد القانونية الموجودة مع هذا الوضع الحرج، أو ضرورة اتخاذ قواعد جديدة أكثر تلاؤما. وقد تبينا من خلال دراسة القانون التونسي والمقارن أن أصحاب القرار مضطرون لإيجاد حلول متوازنة، والاهتداء إلى القرارات الصائبة؛ لتفادي قيام مسؤوليتهم لاحقا. فعلى صاحب القرار إيجاد توازن بين مختلف الحقوق التي يجب حمايتها، وذلك من خلال تطبيق مبدأ التناسب. وقد صدر في هذا الشأن عدة نصوص أدت إلى تغليب الحق في الصحة على بعض الحقوق الأخرى. أما الأطباء ومهنيو الصحة فهم مجبرون على احترام حقوق المريض منذ ولوجه إلى المستشفى وضمان حقه في الفحص دون تمييز، ويتحمل الطبيب المسؤولية الناجمة عن أخطائه، كما يلتزم باحترام القواعد العلمية الثابتة وإن كان من الصعب اليوم- في زمن الكورونا- الحديث عن مثل هذه القواعد. هذا فضلا عن الصعوبات المتعلقة بالعلاج والتلقيح. | ||
| 520 | |b The coronavirus COVID-19 pandemic is an alarming health crisis. The decision-makers are bound to use the existing rules to manage the situation while adopting new legal texts in order to find adequate solutions. Policymakers are facing dilemmas they are obliged to address in order to find balanced solutions. They are to weigh up the interests at stake and observe the principle of proportionality between the different rights and freedoms. From their side, health care professionals are required to comply with a number of obligations upon examination, diagnosis of infection as well as while prescribing the supportive treatment. The doctor must assume the consequences of his or her faults and should respect scientifically accepted data, even though in times of COVID-19 it is difficult to determine “scientifically accepted data”. | ||
