| المستخلص: | تناول هذا البحث أحكام جائحة كورونا المستجد "الصلاة "أنموذجا" دراسة في الفقه الإسلامي والسياسة الشرعية، ومن أهدافه التي سعى إلى تحقيقها: بيان الأحكام الفقهية والسياسة الشرعية المتعلقة بجائحة كورونا المستجد، وإظهار عظمة التشريع الإسلامي في التدابير الوقائية من الأوبئة، وبيان صلاة المصاب والممارس الصحي العاجز عن الطهورين، وتعطيل المساجد أثناء انتشار جائحة كورونا والاكتفاء برفع الأذان فقط، وإقامة الجمعة والجماعة في البيوت والقنوت لرفع الوباء، والأذان في البيوت أثناء انتشار جائحة كورونا، والتباعد بين المصلين أثناء انتشار جائحة كورونا، وحكم صلاة المنفرد خلف الصف أثناء انتشار جائحة كورونا، وقد انتهج الباحثان فيه عدة مناهج وهي المنهج الوصفي والتحليلي والاستنباطي وتوصل الباحثان إلى عدة نتائج منها: أن قرار ولي الأمر بغلق المساجد أثناء جائحة كورونا المستجد، ليس فيه تعطيل للمساجد، ولا منع من ذكر الله ولا من إقام الصلاة، فالمساجد لم تعطل بل سمح بالأذان للصلوات الخمس لما تقتضيه المصلحة العامة، جواز تعطيل صلاة الجمعة والجماعة في المسجد والاكتفاء برفع الأذان لإقامة الشعيرة، أثناء جائحة كورونا، تأييد السياسة الشرعية لما صدر من توجيهات بشأن التباعد بين المصلين أثناء انتشار جائحة كورونا، إقامة صلاة الجمعة في البيوت بسبب انتشار جائحة كورونا لا تجوز. واستنادا للنتائج قدم الباحثان جملة من التوصيات منها: إقامة المؤتمرات والندوات لتوعية الناس بما يجب عليهم القيام به أثناء انتشار جائحة كورونا، وتوضيح الأحكام الفقهية المتعلقة بهذه الجائحة، وطاعة ولاة الأمر واتباع العلماء الربانيين. This research titled: The provisions of the emerging corona pandemic; deals with worship as a model: A study in Islamic jurisprudence and legal policies. One of the goals which this research attempts to realize is to clarify jurisprudence and legal provisions related to the emerging corona pandemic, besides depicting the greatness of Islamic legislation in terms of epidemic prevention measures against epidemics. Moreover, it endeavors to explain the prayer of the infected and the health practitioner who are unable to purify themselves along with disabling mosques during the spread of the Corona pandemic, and only getting restricted to raising the call to prayer. Doing Friday and congregational prayers at homes (praying) to end the epidemic. And the call to prayer at homes during the spread of the Corona pandemic, abiding by the distance between worshipers, and illustrating the provision of praying alone in the row behind during the spread of the Corona pandemic. The researchers adopted several approaches, namely the descriptive, analytical and deductive approach. Several results are attained such as: If the guardian decides to close mosques during the new Corona pandemic, there is no actual disabling to the mosques, nor preventing the remembrance of God or the doing of prayer but supporting the legal policy of the directives issued regarding the distance between worshipers during the spread of the Corona pandemic, and doing Friday prayers at home due to the spread of the pandemic is not permissible. According to the attained results; the researchers made a number of recommendations such as: holding conferences and seminars to educate people about what they should do during the spread of the Corona pandemic, to clarify the jurisprudence provisions related to this pandemic, and to obey the rulers and follow the divine scholars. |
