| 520 | |a تناول هذا البحث تحقيق مخطوطة في فسخ الطلاق وإلغائه، للشيخ أبي الوفاء العرضي الشافعي، وهي رسالة مختصرة في مسألة مهمة من مسائل الطلاق والنكاح، وهذه المسألة في حكم وقوع الطلاق في النكاح المختلف في صحته، والخلاف في اعتبار ذلك النكاح أو إلغائه، ثم هل للمطلق ثلاثا أن ينكح تلك المطلقة بلا محلل؟. وقد تم تحقيق هذه الرسالة على أربع نسخ، وتقسيم البحث إلى أربعة مباحث، في أولها ترجمة لصاحب الرسالة، وفي الثاني دراسة للمخطوطة ومنهج العمل فيها، وفي الثالث دراسة لمسألة الرسالة، وفي الرابع تحقيق للمخطوطة حسب المنهج المبين في المبحث الثاني. وبالله التوفيق. | ||
| 520 | |b This research dealt with a manuscript investigation of the annulment of the divorce and its cancelation, by the the scholar Sheikh Abi Al-Wafa Al-oradi Al-Shafi’i. It is a brief message on an important issue of divorce and marriage, and this issue is about the ruling on the occurrence of divorce in a marriage that is different in its validity, and the disagreement over whether or not that marriage is considered, then can the divorced man marry that divorced woman without her being married to a different man then divorced from the late man? This thesis was investigated in four copies, and the research was divided into four sections; the first section is a translation of the author of the message, the second section is a study of the manuscript and the methodology for working in it, the third section is a study of the issue of the message, and in the fourth section is an investigation of the manuscript according to the approach shown in the second section. | ||
