| المستخلص: | جاء هذا البحث لبيان الأسباب المؤدية إلى اختلاف الحديث النبوي اختلافا ظاهريا، وكيف تعامل معها العلماء، وأثر ذلك على اختلاف الأحكام الشرعية، وقد اشتمل على مقدمة وتمهيد ومبحثين، وقد استنتجت من خلال البحث أن أداء الرواة سواء كان برواية الحديث بالمعنى، أو باختصار الحديث، أو بإدراج زيادات من الراوي على متن الحديث، من أهم أسباب اختلاف الحديث وأقواها أثرا على اختلاف الأحكام الشرعية، وأن الحديث النبوي قد يختلف بسبب اختلاف حال السائل أو الوصف الشرعي للمسألة، أو بسبب اختلاف الزمان، وهذا من مرونة الشريعة الإسلامية وسماحتها، وهو محط عناية الفقهاء، لإبراز حكمة التشريع الإسلامي. This research came to explain the reasons leading to the apparent difference in the prophetic hadith, and how scholars dealt with them, and the effect of that on the different Sharia provisions. It includes an introduction, a preface, and two subjects. I have concluded through this research that the performance of the narrators, whether by narrating the hadith in the sense, or by shortening the hadith, Or by the inclusion of increments from the narrator on the body of the hadith. One of the most important reasons for the difference in the hadith and the one having the strongest impact on the different Sharia provisions is that the prophetic hadith may differ due to the difference in the status of the questioner or the legal description of the issue, or because of the difference in time. This is part of the flexibility and tolerance of Islamic law, and it is the focus of the attention of scholars to highlight the wisdom of Islamic legislation. |
