| المستخلص: | المصطلحات ضرورة علمية تسعى إلى ضبطها وتحديدها الأمم والثقافات المختلفة، فلا يمكن بحال من الأحوال أن تتقدم أمة أو تزدهر حضارتها دون العناية التامة بأمر المصطلحات، فالقانون يمثل هوية الأمة وفق عقيدة معينة، في مجموعة من العادات والتقاليد والأعراف والمعتقدات. وورقتنا البحثية هذه ما هي إلا دراسة لبعض المصطلحات القانونية، ونخص بالذكر مصطلحات قانون الأسرة الجزائري، حيث نلمس بعض التذبذب والاضطراب في الصيغة والمفهوم، وهذا لتداخل بعض المفاهيم، وهذه النماذج المقترحة هي قريبة فيما بينها ودراستنا سوف تحددها وتذكر الفروق التي بينها، في المعاجم اللغوية والمعاجم الاصطلاحية المتخصصة في القانون، والتعرف على المنهجية المتبعة لضبط هذه المصطلحات. Terminology is a scientific necessity that different nations and cultures seek to control and define. It is not possible in any case for a nation to advance or its civilization to flourish without paying full attention to the matter of terminology. The law represents the identity of the nation according to a certain belief, in a set of customs, traditions, customs and beliefs. And our research paper is nothing but a study of some legal terms, and we specifically mention the terms of the Algerian family law, where we sense some fluctuation and turbulence in the formula and the concept, and this is due to the overlap of some concepts, and these proposed models are close to each other and our study will identify them and mention the differences between them, in the linguistic dictionaries and idiomatic dictionaries specialized in law, and to identify the methodology used to control these terms. |
