| المستخلص: | جاءت الدراسة بعنوان تطور حقوق الانسان والحريات العامة وتبدو أهمية الدراسة بأنها من المواضيع المهمة والمعاصرة فهي غاية الحياة ، وتاريخها هو تأريخ البشرية وقد جاءت بها الشرائع السماوية. واتبعت الدراسة المنهج التاريخي والوصفي والتحليلي والمقارن. استعرضت الدراسة التطور التاريخي لحقوق الانسان وحرياته في الحضارات الإنسانية وفي الشرائع السماوية وفي العصر الحديث بشكل موجز ختمت الدراسة بتوضيح أهمية الحقوق والحريات وجذورها التاريخية والروحية لحين صدور الإعلان العالمي لحقوق الانسان الذي نادى بالمساواة بين جميع البشر من أي جنس أو لون أو دين، ذكورا وإناثا. وأهمية الشريعة الإسلامية في تقرير هذه الحقوق وحمايتها بنصوص آمرة حتى لا يقع عليها اعتداءات من الآخرين سواء كانوا حكاما أو محكومين. وأهمية معرفة العوامل الكثيرة التي تداخلت منذ القدم في عملية تطوير الحقوق منها اكتشاف نصوص شريعة حمورابي والذي اعتبر ليومنا هذا مصدرا لكثير من الباحثين والمؤرخين في شتى مواضيع المعارف الإنسانية. اكتملت الدراسة بأهم النتائج: أظهر البحث أنه رغم صدور الإعلان العالمي لحقوق الانسان في العاشر في ديسمبر عام 1948م إلا أن البشر مازالوا يتعرضون للكثير من الانتهاكات في حقوقهم الأساسية في أغلب الدول وذلك دليل على قصور في الجانب التنفيذي للتشريعات الداخلية لهذه الدول في تنفيذ التزاماتها الدولية وأهم التوصيات: ضرورة تفعيل نصوص الاتفاقيات الدولية ضمن التشريعات الداخلية للدول وضرورة اعتبار تعزيز وحماية حقوق الانسان وحرياته الأساسية هدفا ذا أولوية من أهداف الأمم المتحدة وفقا لمقاصدها ومبادئها. The research was titled The Evolution of Human Rights And Freedoms (a legal analytic study). the importance of the research seems from the important and modern topics since its the aim of life. its history is the history of humanity and it was brought by all religious laws. and the research followed the historical, descriptive, analytic, and comparative curricula. research showcased the historical evolution of human rights and freedoms in human civilizations, religious laws, and in the modern age in a clear way. The research finalized by explaining the importance of rights and freedoms and their historical and spiritual roots until the global declaration of human rights which called for equality of all humans from any gender, skin color, or religion. And the importance of Islamic jurisprudence in these rights and protecting them with authoritative scripture so that they are not violated by anyone whether they are rulers or subjects and the importance of the many factors that intervened in its evolution like the discovery of The code of Hammurabi which is considered to this day a source for a lot of researchers and historians from all over the world in many social science subjects. The research concluded with the most important results: the research showed that even though universal human rights were declared on the tenth of September 1948 humans are still suffering a lot of abuses of their fundamental rights in most countries. Which is proof of the inadequacy of the executive branch of some countries in enforcing laws that are their global responsibilities. The most important consultations: the importance of activating global treaties within the internal laws of countries and the importance of considering the topic of strengthening and protecting basic human rights and freedoms a global goal that is given priority from the goals of the United Nations according to its objectives and principle. |
