| المستخلص: | هدفت الدراسة لتبين أنّ موضوع الشهادة بصورة عامة وشهادة الاسترعاء بصورة خاصة من أدق الموضوعات التي سعت الشريعة الإسلامية لتأصيلها حفظاً للحقوق وصيانةً لها. ويتمثل الهدف من البحث تنبيه أصحاب الحقوق إلى تعدد الطرق وتنوعها في حفظ حقوقهم وإثباتها. وتتمثل مشكلة الدراسة في توضيح المكانة التي تحتلها شهادة الاسترعاء في الشريعة الإسلامية، وما مدى سلطات القاضي في تقدير الإثبات بشهادة الاسترعاء؟ ومن أهم الأهداف المرجوة من البحث بيان توسيع الشريعة الإسلامية دائرة حفظ الحقوق والاستشهاد على حفظها. واعتمدت الدراسة على المنهج الاستقرائي التحليلي وذلك بالرجوع إلى أمهات كتب الفقه واللغة والمراجع الفقهية الحديثة لتوفير المادة العلمية المتعلقة بالموضوع. وخلُصت الدراسة إلى عدة نتائج منها: أن العمل بشهادة الاسترعاء مخرج شرعي وحيلة شرعية أصيلة لكل مُكره ومغلوب ومقهور. The study aimed to show that the subject of the testimony in general and testimony of invocation (Istiraa) in Particular, it is one the most accurate topics which the Islamic sharia sought to roof for preservation rights and their protection. The aim of the search is to alert rights holders to infringement methods and their diver-sity in preserving and proving their rights. The problem of study is to clarifying the position which occupies– of Istiraa in Islamic law, and what is the extent of the judge’s power, estimation of proof Testimony of Istiraa. One of the most important objectives of the research is an expansion statement, of the Islamic sharia is the department for preserving rights and martyrdom for preserving them. The study was adopted on the inductive– analytical methods by reference to the mothers of the books of Jurisprudence and language and modern jurisprudence reference provide Scientific material related to the topic. The study concluded to several results: that acting with Istiraa Testament is Legitimate way out and an authentic legal trick for every hated, defeated and oppressed. |
