| المستخلص: | Based on the need to provide a legal and social framework that respects and protects the humanity of the elderly and to create an international and national environment that ensures a society for all ages. This group should receive the attention required, especially in the light of the international development of the rights of the elderly, It was necessary to review the legal reality of the elderly in Iraq, to uncover the basic trends of this reality, and then find out the compatibility with the international obligations of Iraq to the elderly, and reflect on the new directions to be taken, as long as it is necessary, And the rules of public international law require the recognition of the legal personality of the human being as a fundamental right to be associated with it, which begins with his life and ends with his death. The Universal Declaration of Human Rights Of 1798 states that "Every person, wherever he may be, has the right to be recognized as a juridical person". This right is not restricted by a condition or restriction based on the existence of a person. Therefore, such protection is not affected by the stages of life or citizenship, The scope of such protection is not limited To improve the quality of life of this group, to make it more comfortable, comfortable and enjoyable, which requires that such legal protection be formulated in the form of rights guaranteed by the law, all responsible parties are committed to their families and the state to which they belong and the organizations concerned to empower them Especially as such protection is one of the common principles agreed upon by States under Article 55 of the United Nations Charter to achieve a lasting peace among peoples and a social justice that promotes and enshrines collective security in every State. انطلاقا من ضرورة توفير إطار قانوني واجتماعي يحترم إنسانية المسنين ويحميهم، ومن تهيئة بيئة دولية ووطنية تضمن قيام مجتمع لجميع الأعمار، ولكي تحظى هذه الفئة بالاهتمام المطلوب، لا سيما في ضوء التطور الحاصل دوليا في حقوق المسنين والمؤسس على القواعد المقررة في القانون الدولي لحقوق الإنسان، كان لابد من استعراض الواقع القانوني للمسنين في العراق، لكشف الاتجاهات الأساسية لهذا الواقع، ومن ثم استخلاص مدى توافق ذلك مع الالتزامات الدولية للعراق تجاه المسنين، والتمعن في الاتجاهات الجديدة التي يجب اتخاذها، طالما وجد ضرورة لذلك، وهذا الأمر أقتضى الرجوع إلى العديد من القوانين النافذة في العراق ابتداء من دستوره مرورا بالقوانين الأساسية ذات الصلة بموضوع الدراسة، ولما كانت قواعد القانون الدولي العام توجب الاعتراف بالشخصية القانونية للإنسان باعتباره حقا أساسيا لصيق به، يبدأ بحياته وينتهي بوفاته، حيث نصت م/ من الإعلان العالمي لحقوق الإنسان لسنه ١٧٩٨ على أن ((لكل أنسان أينما وجد، الحق في أن يعترف له بالشخصية القانونية))، فهذا الحق غير مقيد بشرط أو قيد يقوم على أساس وجود الإنسان، وعليه فان تلك الحماية لا تتأثر بمراحل العمر أو الأهلية، خاصة أذا اخذ بنظر الاعتبار أن نطاق تلك الحماية لا يقتصر على توفير الغذاء أو الكساء وتدبير الضروريات وحسب، بل يتوجب تحسين نوعية حياة هذه الفئة، وجعلها أكثر رقيا وراحة ومتعة، الأمر الذي يستدعي أن تصاغ تلك الحماية القانونية بشكل حقوق منظمة يكفلها القانون، تلتزم كل الجهات المسؤولة بداء بذويهم والدولة التي ينتمون إليها والمنظمات المعنية بتمكينهم منها، خاصة وأن تلك الحماية تعد من المبادئ المشتركة التي اتفقت عليها الدول، بموجب م/ 55 من ميثاق منظمة الأمم المتحدة، لبلوغ سلام دائم بين الشعوب، وعدل اجتماعي يعزز ويكرس الأمن الجماعي في كل دولة. |
