| 520 | |a تهدف هذه الدراسة إلى التعرف على مفهوم المؤسسة ومعايير تكييفها في ظل قانون المنافسة حيث نجد أن تشريعات المنافسة الحديثة وسعت من هذا المفهوم معتمدة في ذلك على النشاط الاقتصادي الذي يمارسه المتدخل في السوق بغض النظر عن صنفه وشكله القانوني، وهو ما ذهب إليه المشرع الجزائري فأخضع كل الأشخاص الطبيعية والمعنوية إلى جانب المنظمات والنقابات والجمعيات وكذا الأشخاص العمومية إلى أحكام قانون المنافسة، متى مارس الكيان نشاطا اقتصاديا، وهذا من أجل حماية مبدأ المنافسة في السوق، فالمؤسسة تعتبر الركيزة الأولى في السوق التنافسية ومن دونها لا يوجد سوق بمعنى قانون المنافسة، كما وسع المشرع أيضا من مفهوم النشاط الاقتصادي الممارس من قبلها فأخضع كل النشاطات التي تظهر في السوق إلى قانون المنافسة بما فيها الصفقات العمومية. | ||
| 520 | |b This study aims to identify the concept of the enterprise and the criteria for its adaptation under the competition law, as we find that modern competition legislation has expanded this concept depending on the economic activity practiced by the intervener in the market, regardless of its class and legal form. This is what the Algerian legislator went to, so he subjected all natural and moral persons, as well as organizations, unions and associations, beside public persons to the provisions of the competition law, whenever the entity practiced economic activity, and this was in order to protect the principle of competition in the market, so the institution is considered the first pillar in the competitive market and without it there is no Market in the sense of competition law. The legislator has also expanded the concept of economic activity practiced by it, thus subjecting all activities that appear in the market to the competition law, including public deals. | ||
| 520 | |d L’objectif de cette étude vise à identifier la définition de l’entreprise et ses normes d’adaptation selon le droit de la concurrence ; ou on trouve les législations sur ce, élargie la définition, en s’appuyant sur l’activité économique que les intervenants dans le marché pratiquent indépendamment de sa forme ou de sa catégorie. Ce que le législateur algérien à adopter ou il a soumis la totalité des personnes physiques et morales, les organisations, les syndicats, les associations, et les personnes publiques aux dispositions du droit de la concurrence quand cet organisme exerce une activité économique, pour protéger le principe de concurrence dans le marché. L’entreprise est considérée comme premier fondement essentiel du marché selon les normes du droit de la concurrence. Le législateur a aussi élargi la définition de l’activité économique que ces derniers exercent et il a soumit toutes les activités qui apparaissent sur le marché ainsi que celles des marchés publiques aux droit de la concurrence. | ||
