| المستخلص: | يناقش هذا البحث أصل مراعاة الخلاف والوقوف على أثره في الترابط الفقهي بين المذاهب المختلفة ولا يعتبر هذا الأصل تلفيقاً ولا تنقلاً بين المذاهب ولا خروجاً على مذهب المجتهد إلى العمل باجتهاد غيره الخاطئ، بل هو عمل بلازم دليل مذهبه ولازم مدلول مذهب مخالفه، وركزت الدراسة على اعتبار هذا الأصل في جميع المذاهب وتحرير الجواب في قوادح الاستدلال للخروج برجحان الاحتجاج به. ويتناول هذا البحث أيضا الغاية من دراسة الخلاف الفقهي وضرورة مراعاته والخروج منه وآداب الخلاف والمناظرة. وفي البحث نايل علي صلة مراعاة الخلاف بالعلوم الأخرى كعلم المنطق واللغة والكلام، ويحتوي البحث على صور تطبيقية ونماذج فقهية مبنية على مراعاة الخلاف بين المذاهب الإسلامية واستدلالات أصولية تدل على اعتبار مراعاة الخلاف أصلا معتبر في هذه المذاهب وبما يدل على أن غاية العلماء من مراعاة الخلاف هو حصول الوفاق ورغبة في ظهور الحق والصواب على لسان الخصم. This research discusses the origin of taking into account the dispute and its impact on the jurisprudential interrelationship between the different schools of thought. This is the principle in all the schools of thought and the editing of the answer is in the inferences of inference to come out with the preponderance of invoking it. This research also deals with the purpose of studying the doctrinal dispute, the necessity of taking it into account and getting out of it, and the etiquette of dispute and debate. In the research, Nile is related to the observance of disagreement with other sciences, such as the science of logic, language, and speech. The research contains applied images and jurisprudential models based on taking into account the difference between Islamic sects and fundamentalist inferences that indicate that taking into account the difference is an important principle in these sects and which indicates that the goal of scholars in taking into account the difference is Accomplishment of reconciliation and a desire for truth and righteousness to appear on the tongue of the opponent. |
