| المستخلص: | Les préceptes religieux et les droits positifs imposent le droit de l'enfant à la protection sous toutes ses formes. Avec la propagation des fléaux sociaux, Cette catégorie fragile est devenue vulnérable à de nombreux crimes qui menacent leur sécurité, leur éducation et leur moralité. Le législateur a adopté la loi n° 15.12 relative à la protection de l'enfant comme cadre approprié pour mettre des règles et des mécanismes distincts de ceux qui sont prescrits aux adultes pour assurer une protection efficace de l'enfant. Où la tâche de l'enquête et de l’instruction relève de la compétence des agents et des juges qui ont une formation spécialisée de la délinquance juvénile. تفرض التعاليم الدينية والقوانين الوضعية حق الطفل في الحماية بكافة أشكالها. ومع انتشار الآفات الاجتماعية، أصبحت هذه الفئة الهشة عرضة لجرائم عديدة، تهدد أمنهم وتربيتهم وأخلاقهم. وعليه أصدر المشرع القانون 15-12 يتعلق بحماية الطفل ليكون الإطار المناسب لوضع قواعد وآليات متميزة عن تلك المقررة للبالغين تكفل حماية فعالة للطفل، حيث جعل مهمة التحري والتحقيق في قضاياهم من اختصاص أعوان وقضاة لهم تكوين خاص بشؤون الأحداث الجانحين. Religious ethics and laws impose the right to protection in all its sorts for the child. With the spread of social lesions, this vulnerable category has become at risk to many crimes, threatening their safety, education and moralities…For that, the Algerian legislator has issued the Child Protection Act No. 15/12, as an appropriate framework putting special rules and mechanisms characterized from those prescribed for adults, to ensure an effective protection to the child. Where the mission of investigation and instruction is dedicated to agents and judges who are specialized of treating delinquent juvenile. |
