| المستخلص: | يهدف هذا البحث إلى بيان الجانب السلبي للتوظيف المقاصدي للنصوص الشرعية عموما والنص الحديثي خصوصا، إذ كثير ممن تنكب طريق الوسطية والاعتدال انتهج مسالك الإفراط والتفريط، أو الشد والإرخاء في استخدامه المقاصد الشرعية في فهم النصوص والاستنباط منها، حيث تولد عنه فهوم لا تمت لروح الشريعة وسماحتها بسبب، مما دعانا لضرورة عرض أسباب هذا التوظيف المقاصدي المجانب للمنهج العلمي السليم، شافعين ذلك ببعض الطرق العلاجية له، ومذيلين له بقصيدة شعرية تضم بين جنباتها كيفية التعامل الصحيح مع الفهم المقاصدي للنصوص. This research aims to explain the negative side of the intended use of the legal texts in general and the hadith text in particular, as many of those who devoted themselves to the path of moderation and temperance have pursued the paths of excess and neglect, or tension and relaxation in their use of legal objectives in understanding the texts and deducing from them, as they generate an understanding that is not fulfilled by the spirit of The Sharia and its tolerance because of that, which calls for us to present the reasons for this intentional employment outside of the sound scientific method, interfering with that with some remedial methods for it, and appending it with a poem that includes among its aspects the correct way of dealing with the intentional understanding of the texts. |
