| المستخلص: | هدفت هذه الدراسة إلى إبراز حظ الفهم المقاصدي للسنة النبوية عند الصحابة الكرام، والتنبيه إلى أنه عريق الأصول كانت لبناته الأولى في حضرة النبي صلي الله عليه وسلم، فقد درّبهم عليه ورغبهم في الاجتهاد، لذا كانوا خير من فهم السنّة النبوية، وأحسن من قدّ ر المصالح والمفاسد تقديرا صحيحا؛ فإعمال المقاصد على وجهها البديع يجري في ذوقهم التشريعي، ظهر فيما خلفوه من نماذج رائدة يحسن الاهتداء بها، فهي تشكل المرجعية الأساسية والبوصلة الهادية للمنطلق الصحيح والفهم المقاصدي المنضبط. This study aimed to highlight the Maqasid understanding of the prophetic Sunnah among the noble Companions, With the necessity of noting that it is ancient in origins, as its beginnings were in the era of the Prophet, as he trained them in ijtihad. Therefore, they consider the best understanding of the Prophet’s Sunnah, and the best one who is able to correctly estimate interests and harms. They used the maqasid in Islamic legislation, and this is evident in what they left of models that it is desirable to emulate, as they constitute the basic reference and guiding compass for the correct approach and the disciplined understanding of maqasid. |
