| المستخلص: | الحمد لله الذي مَن على عباده بالإسلام، وهداهم تعالى لاتخاذ القضاء ميزانا يُحكم به فيما هم فيه يختلفون، وصلى الله وسلم على نبينا محمد وآله أجمعين، وبعد: فبالنظر إلى عنوان هذا البحث المسمى "السياسة الاستثنائية القضائية في الكتاب" يجد الناظر أن موضوعه قائم على سياسات استثنائية قضائية، إلى موضع تطبيقها -على سبيل المثال-: السياسة الاستثنائية القضائية في قبول شهادة غير المسلم على المسلم، وفي البغي بين الخلطاء، إذ في ذلك تكمن مشكلة هذا البحث القائمة على أن الحل للمشكلة المؤدية إلى تنبيه الجهة العدلية الرسمية للاهتمام بذلك المرفق القضائي، ولا يكون ذلك إلا باعتماد أن هذا التطوير مدرج في خطة تطوير قضائي ذات بال على المدى المتوسط والبعيد؛ وبذلك تتحقق أهداف موضوعية مرتكزة على اكتشاف أحكام وحكم السياسة الاستثنائية القضائية في القرآن الكريم، وللتوصل إلى العلم بالأسس العامة في السياسة الاستثنائية القضائية الشرعية، المؤدية إلى نفي العسر واستبداله باليسر، ووسيلتنا إلى ذلك اتباع منهج الاستنباط والاستقراء، ومن ذلك كله نحصل على نتائج مهمة أبرزها: أن سياسة الاستثناء القضائي في الكتاب تعتبر طريقا موصلا إلى إيجاد حلول مناسبة للمسائل القضائية الطارئة. Praise be to Allah, who is overflowing on his slaves the Islam, and guided them to take the judiciary as a balance to be judged by what they are different in, and peace and blessings are upon our Prophet Muhammad. In view of the title of this research called: "exceptional judicial policy in the Holy Quran ", the viewer finds that his subject is based on exceptional judicial policies, Which position is applied - for example - is: The exceptional judicial policy of accepting a non-Muslim certificate against a Muslim, And in the assault between the partners, In this lies the problem of this research that the solution to the problem leads to alerting the official judicial body to the attention take care of that judicial facility, This should be done only if such development is included in a medium-term and long-term judicial development plan, And thus achieve objective objectives based on the discovery of the provisions and the wisdom of exceptional judicial policy in the Holy Quran, and to get to know of the general foundations of the exceptional legal judicial policy, leading to the replacement of hardship to easy, and we have to follow the method of induction and deductive, And all of this we get important results, most notably that the policy of judicial exception in the book is a way to find appropriate solutions to emergency judicial matters. |
