| المستخلص: | في ظل الأوضاع المضطربة التي تشهدها الجغرافية العربية والإسلامية بوجه خاص والخارطة العالمية بوجه عام من مظاهر الاحتجاجات- السلمية والعنفية ـ والتي تكشف عن خلل في آلية الوصول إلى أنظمة الحكم التي أفرزت مصادرة الحقوق والحريات، تبرز الحاجة إلى تسليط الضوء على التعريف بالمعارضة السياسية والفكرية، وتتبع مسيرتها التأريخية، والتعرف على موقف الشريعة الإسلامية والقانون الوضعي منها. هذا البحث محاولة في التعرف على ماهية المعارضة السياسية والكشف عن رأي الشريعة الإسلامية المقدسة والقانون الوضعي، ومحاولة عقد مقارنة بينهما، وقد جاء في مقدمة وأربعة مباحث. تناول الأول منها التعريف بماهية المعارضة السياسية في معاجم اللغة ولدى العلماء المتخصصين، والتعرف كذلك على مفهومها في المنظور القرآني والفقهي. بينما تخصص الثاني في متابعة المعارضة السياسية لدى المجتمعات الإنسانية السابقة عبر تسليط الضوء حول التعامل معها من الحكام في العصور التاريخية السالفة. وأما المبحث الثالث فقد درس الأبعاد العامة للمعارضة السياسية، في حين تناول المبحث الرابع التأصيل الشرعي والقانوني للمعارضة السياسية، بعدئذ عرضنا لأهم النتائج التي أفرزها البحث واستخلصها، ثم عرض لأهم المصادر التي أفادها منها الباحث وقد توزعت بين علوم القرآن الكريم والسياسة والفقه ومعاجم اللغة والتاريخ. In light of the turbulent conditions in the Arab and Islamic geography in particular and the global map in general from manifestations of protests - peaceful and violent - which reveal a flaw in the mechanism of access to governance systems that resulted in the confiscation of rights and freedoms, the need to shed light on the definition of political and intellectual opposition, and to follow Her historical career, and recognition of the position of Islamic law and positive law about it. This research is an attempt to identify what the political opposition is and to reveal the opinion of the sacred Islamic law and positive law, and an attempt to draw a comparison between them. The first dealt with introducing the essence of political opposition in language dictionaries and among specialized scholars, and also identifying its concept in the Qur’an and jurisprudential perspective. While the second specializes in following up the political opposition of previous human societies by shedding light on dealing with it by rulers in previous historical eras. As for the third topic, it examined the general dimensions of political opposition, while the fourth topic dealt with the legal and legal establishment of the political opposition.
