| 520 | |a نظر للوظيفة الاجتماعية التي أصبحت تؤديها الملكية العقارية وخاصة ملكية للأراضي الفلاحية، أصدر المشرع الجزائري القانون رقم 90-25 المتضمن التوجيه العقاري الذي جاء لتحديد عناصر السياسة العقارية الجديدة، عن طريق وضع ضوابط وقيود للتصرف في الأراضي الفلاحية وعدم اعتبار المالك حرا في التصرف في ملكيته العقارية الفلاحية، من بين هذه الضوابط احترام المساحة المرجعية عند تجزئة الأراضي الفلاحية عن طريق التصرف فيها أيا كان نوع التصرف وقد نظم شروط وإجراءات تجزئة الأراضي الفلاحية بموجب المرسوم التنفيذي رقم 97-490 ورتب البطلان المطلق في حالة الإخلال بالتصرف. إلا أن عدم كفاية هذه الضوابط وعدم وضوحها خلق إشكالات على أرض الواقع هددت الحفاظ على الطابع الفلاحي للأراضي. | ||
