| المستخلص: | عندما يقع الناس في الفقر والحاجة، ثم يحتاجون إلى من يساعدهم، لكي يشعروا أنهم جزء من مجتمعهم، فالتكافل الاجتماعي أحسن وسيلة إلى ذلك. ولكن هذا التكافل الاجتماعي في أصله نابع من إرادة الإنسان وإيمانه بالله، وما دام هذا الإيمان موجودا فإن الغني يساعد الفقير، والقادر يساعد العاجز. ثم إن هذا الإيمان لا يستقر على حالة واحدة فقد يصبح ضعيفا، وحينئذ يخف مستوى التكافل الاجتماعي بين الناس. وهذا ما جعل الفقه الإسلامي يجعل الدولة مسؤولة عن المحتاجين والفقراء، فتحث القادرين على تحقيق التكافل مع إخوانهم، لكن مع احترام قواعد الشرع الإسلامي، وترك الظلم للغني أو الفقير. وقد قصدت من هذا البحث بيان وظيفة الدولة العادلة في تحقيق التكافل الاجتماعي، عندما يتخلى عنه الناس بسبب ضعف إرادتهم وقلة رغبتهم وإيمانهم لأجل ضمان حق الجميع في العيش الكريم. When people fall into poverty and need, then they need someone to help them, in order to feel that they are part of their community, social solidarity is the best way to do that. But this social solidarity in its origin stems from the human will and his belief in God, and as long as this faith exists, the rich help the poor, and the able helps the disabled. Moreover, this belief does not settle on one case, it may become weak, and at that time the level of social solidarity among people diminishes. This is what made Islamic jurisprudence make the state responsible for the needy and the poor, urging those who are able to achieve solidarity with their brothers, but with respect to the rules of Islamic law and leaving oppression to the rich or the poor. I have intended from this research to clarify the just function of the state in achieving social solidarity when people abandon it due to their weak will and lack of desire and belief in order to guarantee everyone's right to a decent life. |
